عنوان فارسی تأملی پیرامون شرط ضمنی دوام زوجیت در هبه‌ی بین زوجین و ماهیت آن
چکیده فارسی مقاله در مورد وضعیت هبه بین زوجین در فقه امامیه و حقوق­ ایران دیدگاه­های متعددی مطرح‌شده است. برخی از فقها و حقوق‌دانان بر این باورند که هبه بین زوجین قابل رجوع است و زوجیت دلیلی بر عدم امکان رجوع نیست. اما عده‌ای از فقها بر این باورند زوجیت دلیلی بر عدم امکان رجوع از هبه است و پس از هبه زوجین به یکدیگر، دیگر امکان رجوع وجود ندارد. جدا از دیدگاه­های مطرح‌شده در مورد وضعیت هبه بین زوجین، این سوال قابل‌طرح است که هبه­ در دوران زندگی مشترک بین زوجین مطلق است یا مقید به‌شرط ضمنی دوام زوجیت؟ منظور از مقید بودن به‌شرط ضمنی دوام زوجیت این است که زوجین با فرض دوام زوجیت مالی را به همسر خود هبه می­کنند و انعقاد هبه در دوران زندگی مشترک مطلق نیست. به همین علت پس از تخلف متهب، واهب خواهان بازپس‌گیری مال موهوبه می­باشد. درصورتی‌که قائل به مقید بودن هبه بین زوجین در دوران زندگی مشترک باشیم؛ مسائل دیگری ازجمله دلایل وجود شرط ضمنی دوام زوجیت، ماهیت شرط ضمنی دوام زوجیت و ... قابل‌طرح است که به تبیین این موارد خواهم پرداخت.

In the sense of being bound by the implicit condition of survival, the duration of the couple is that the couples, given the assumption of the continuity of the financial couple to their spouse, make the coexistence of the coin in absolute lifetime not absolute. For this reason, after a violent violation, you will be required to regain money. If we consider the attachment of the couple between the couples during a lifetime, there are other issues, including the reasons for the implicit condition of the couple's durability, the nature of the implicit condition of the durability of the couple, etc. We can explain this.
