عنوان فارسی مدیات وحدود العقل فی الإستنباط عند العلامه البهبهانی
چکیده فارسی مقاله یتناول هذا المقال دور ودائره العقل فی استنباط الأحکام الشرعیه من وجهه نظر أستاذ الکلّ، الوحید البهبهانیّ. إن العلّامه الوحید البهبهانیّ وبالرغم من اعتقاده بکون الأحکام الشرعیه بأسرها توقیفیّه موقوفه علی نصّ سواءً کانت فی العبادات أم المعاملات، لکنه یُقرّ دوراً هامّاً للعقل فی استنباط الأحکام الخاصّه بالمعاملات. فعلی عکس الاخباریّین، قام باستنباط أحکام الشریعه انطلاقاً من قواعد عقلیه متعدّده واستند إلیها فی کل مناحی الفقه. من قاعده "الحسن والقبح العقلیین الذاتیین للأفعال"، "عدم صدور القبیح عن الحکیم"، "قبح ترجیح المرجوح علی الراجح"، "قبح تکلیف الغافل والجاهل والمجنون"، "قبح تأخیر البیان عن وقت الحاجه"، "تقدیم الأهمّ علی المهمّ فی مقام التزاحم"، "لزوم دفع الضرر المحتمل والمظنون"، "عدم جواز (قبح) التکلیف بما لا یطاق"، "وجوب البراءه الیقینیه عند اشتغال الذمّه بها یقیناً"، "قبح العقاب بلا بیان"، "الملازمه بین حکم العقل والشرع"، "تقدم القاعده علی النصّ". فضلاً عن تلک القواعد، یمارس العقل من وجهه نظر البهبهانیّ دوراً خلّاقاً وریادیاً فی عملیه الاستنباط علی الأصعده التالیه: "کشف الأحکام الشرعیه"، "توسعه وتضییق الأحکام" و"معرفه الموضوعات فی دائره المعاملات الواسعه وبالتالی استنباط الحکم".
