تعلیق حقوق و آزادی‌ها در قانون اساسی جمهوری اسلامی ایران در پرتو اسناد حقوق بشری |

با پیش‌بینی نظام تحدید حقوق و آزادی‌ها در حالت عادی و وجود نظام تعلیق در شرایط اضطراری و نیز تفکیک حقوق تعلیق‌پذیر از حقوق تعلق‌ناپذیر در اسناد حقوق بشری، تا اندازه‌ای وضعیت آزادی‌ها در نظام فراملی حقوق بشر روشن شده است. قانون اساسی ایران ضمن پیش‌بینی عناصر محدودکننده آزادی‌ها، در اصل 79 به صورت اختصاصی به حالت اضطراری و وضعیت آزادی‌ها در این شرایط پرداخته است و ضمن ممنوع‌کردن حکومت نظامی، از برقراری محدودیت‌های ضروری سخن گفته است؛ ولی آشکارا چیزی تحت عنوان تعلیق حقوق و آزادی‌ها در شرایط اضطراری مقرر نکرده است. این مقاله به بررسی اصول قانون اساسی برای شناخت معیارهای تحدید آزادی‌ها، شناسایی حقوق تعلق‌پذیر و تعلیق‌ناپذیر در قانون اساسی و به‌طور کلی بررسی امکان تعلیق حقوق و آزادی‌ها در قانون اساسی می‌پردازد. در واقع هدف از این بررسی، ارائه تصویر روشنی از وضعیت آزادی‌ها در شرایط اضطراری و مشخص‌کردن رویکرد قانون اساسی نسبت به حق تعلیقِ مصرح در اسناد حقوق بشری است. گفتنی است ابهام‌زدایی از وضعیت آزادی‌ها در قانون اساسی ایران، کمک شایسته‌ای برای حفظ هرچه بیشتر این حقوق در همه شرایط به خصوص در شرایط اضطراری می‌تواند باشد که اهمیت موضوع بیشتر نمود می‌یابد. شروط لازم در برقراری محدودیت‌های ضروری، شناسایی حق تعلیق آزادی‌ها در اصول قانون اساسی و مشخص‌کردن حقوق تعلیق‌ناپذیر و دور از دسترس دولت در شرایط اضطراری، از مباحث پژوهش پیش رو می‌باشد. |

With the prediction of a system of restriction on rights and liberties under normal conditions and a system of suspension as well as separation between rights which may be suspended and those which may not, the situation of liberties has been somehow clarified in the trans-national system of human rights. Iranian Constitution has forecasted elements which may limit liberties and in the Article 79 has specially discussed emergency conditions and situation of liberties under such conditions. While forbidding proclamation of martial law, this article has spoken of necessary restrictions. However, it has not specified something as suspension of rights and liberties under emergency conditions. The present article discusses articles of the Constitution to recognize criteria for restricting liberties, rigts which may be suspended and rights which may not and, generally speaking, possibility of suspension of rights and liberties in the Constitution. As a matter of fact, the present article aims to provide a clear insight of the situation of liberties under emergency conditions and specify the Constitution’s approach to the right to suspension mentioned in the human rights documents. It should be noted that clarification of the situation of liberties in the Iranian Constitution will greatly help to protect such rights under all conditions and in particular under emergency conditions; and, thus, the importance of the subject will be shown. Conditions necessary for establishing necessary restrictions, the right to suspension liberties in the Constitution and specification of the rights which may not be suspended by the government under emergency conditions are among issues discussed in the present study. |
