چکیده یکی از آسیب های مهم اجتماعی جریان و شیوع غیبت یا اظهار نقص دیگران و از سکه انداختن افراد با انگیزه های مختلف است. که می تواند انگیزه فردی و یا جمعی و یا سیاسی داشته باشد. ولی بر اساس مصالح عقلایی در مواردی این امر استثناء شده است که از جمله آنها غیبت شخص متجاهر به فسق است از این رو شناخت صحیح معنای فقهی غیبت و متجاهر به فسق به عنوان موضوع شناسی احکام و بیان احکام شرعی آن از دیدگاه علمای امامیه (اثنا عشری) و اهل سنت مهمترین اهداف تحقیق حاضر می‌باشد . بر همین اساس روش به کار گرفته شده در تحقیق حاضر روش بیان و تحلیل و توصیف مفاهیم لغوی و اصطلاحی در فصل ادبیات تحقیق و بیان و بررسی دلایل ارائه شده توسط هر یک از دو مذهب بزرگ اسلامی است. که نتیجه آن جواز غیبت متجاهر به فسق به عنوان تخصیص حرمت غیبت و در مواردی وجوب از باب نهی از منکر است و مضمون نوع ادله فریقین مثل هم می باشد. |
