عنوان فارسی بررسی موارد معافیت از مسئولیت مدنی کارکنان نیروهای مسلّح
چکیده فارسی مقاله زمینه و هدف: کارکنان نیروهای مسلح با توجه به مجموع وظایف و ماموریت­هایی که دارند، ممکن است در اثر اقداماتی که انجام می­دهند مشمول مسئولیت­های متعددی از جمله مسئولیت مدنی قرار گیرند. مسئولیت مدنی و شرایط تحقق آن در مورد کارکنان نیروهای مسلح، به جزء در برخی از موارد خاص همان مواردی است که در خصوص اشخاص عادی پیش­بینی گردیده است اما از نظر، علل رافع مسئولیت یا اسباب معافیت از مسئولیت مدنی، تفاوت­هایی بین آنها وجود دارد. هدف از پژوهش حاضر، تبیین مصادیق معافیت از مسئولیت مدنی کارکنان نیروهای مسلح و شناخت تفاوت­هایی است که در شمول این مصادیق برای این کارکنان در مقایسه با افراد عادی وجود دارد.
روش ­شناسی: پژوهش از نوع توصیفی – تحلیلی بوده که به روش­ کتابخانه­ای - اسنادی به نگارش در آمده و از نظر هدف کاربردی است.
یافته ­ها: یافته­های پژوهش نشان می­دهد، علل رافع مسئولیت یا اسباب معافیت از مسئولیت، یکی از مهمترین قواعد عمومی در بحث مسئولیت مدنی است که مصادیق آن عبارتند از: 1- قوّه قاهره، 2- اقدام زیاندیده، 3-تقصیر زیاندیده، 4- حکم قانون و امر آمر قانونی، 5- اضطرار،  6- رضایت زیاندیده، 7- تحذیر (هشدار)،  8- دفاع مشروع.
نتایج: اسباب معافیت از مسئولیت مدنی، اسبابی هستند که تحت شرایطی مرتکب رفتار زیانبار را از مسئولیت معاف می­کند. با توجه به اینکه؛ کارکنان نیروهای مسلح در انجام وظایف و ماموریت­های خود در موارد متعددی ممکن است رفتارهای زیانباری داشته باشند، پیش­بینی این اسباب مانع برقراری رابطه سببیت بین رفتار زیانبار و خسارت وارده شده و آنها از مسئولیت رهایی می­یابند. نتایج نشان می­دهند گستره این اسباب در مورد کارکنان نیروهای مسلح با توجه با اهمیت ماموریت­هایی که بر عهده دارند وسیع­تر بوده و آنها می­توانند در موارد متعددی علی­رغم ورود خسارت با استناد به هر یک از این اسباب از مسئولیت مدنی رهایی یابند.

عنوان انگلیسی Investigating cases of exemption from civil liability of armed forces personnel
چکیده انگلیسی مقاله Background and Objective: Armed forces personnel, considering the totality of their duties and missions, may be subject to various responsibilities, including civil liability, as a result of the actions they take. Civil liability and the conditions for its realization for armed forces personnel, except in some special cases, are the same as those foreseen for ordinary persons, but there are differences between them in terms of the causes of liability or the reasons for exemption from civil liability. The purpose of the present study is to explain the instances of exemption from civil liability of armed forces personnel and to identify the differences that exist in the inclusion of these instances for these personnel compared to ordinary persons.
Methodology: The research is descriptive-analytical, written using a library-documentary method, and is practical in terms of purpose.
Findings: The findings of the study show that the causes of liability or reasons for exemption from liability are one of the most important general rules in the discussion of civil liability, examples of which include: 1- Force majeure, 2- Action of the injured party, 3- Fault of the injured party, 4- Law and order of the legal authority, 5- Emergency, 6- Consent of the injured party, 7- Warning, 8- Self-defense.
Results: The grounds for exemption from civil liability are grounds that, under certain conditions, exempt the perpetrator of harmful behavior from liability. Given that; Armed Forces personnel may engage in harmful behavior in many cases while performing their duties and missions, the prediction of these grounds prevents the establishment of a causal relationship between harmful behavior and damage, and they are exempted from liability. The results show that the scope of these grounds for Armed Forces personnel is broader due to the importance of the missions they are responsible for, and they can be exempted from civil liability in many cases, despite the damage caused, by citing any of these grounds.
