چکیده فارسی مقاله موضوع مالکیت معنوی که ناشی از هنر و ابتکارات انسان است، اگر چه بحث از آن در حقوق موضوعه دارای سابقه‌ای نسبتاً طولانی می‌باشد، اما در فقه امامیه در عصر حاضر مورد بررسی جدی قرار گرفته است. طرح این موضوع در مجامع فقهی دیدگاه‌های متفاوتی را از سوی فقها در پی داشته است؛ به­طوری که برخی آن را همانند مالکیت مادی محترم شمرده و بعضی چون امام خمینی اعتباری برای آن قائل نشده‌اند. با توجه به گسترش ارتباطات از طریق شبکۀ جهانی اینترنت و قابلیت دسترسی سریع و آسان به تمامی اطلاعات و امکان استفادۀ برخی افراد از آثار و دستاوردهای دیگران ضرورت این پژوهش روشن می‌شود. در این تحقیق که به صورت توصیفی تحلیلی انجام پذیرفته، با بررسی دیدگاه و ادلۀ امام خمینی و نیز بررسی دلایل قائلان مالکیت معنوی چنین به دست آمده است که دیدگاه امام صحیح‌تر به نظر می‌رسد

چکیده انگلیسی مقاله AbstractIntellectual ownership is an instance of mankind,s innovations. Although discussions about it have a relatively long history, it has just recently been taken into serious consideration in the present age in Shiite jurisprudence. Raising this topic in communities of jurisprudents has led to different perspectives by different jurisprudents. Some of them have respected it just as they respect property ownership and some have not given any value to it including Imam Khomeini. Due to the spread of information through the Internet, quick and easy access to a lot of information and the possibility of some individuals> making use of other persons> works and achievements, conducting this study seems to be necessary. This piece of research which adopts a descriptive analytical method, investigates Imam Khomeini,s perspectives and reasons and compares them with the reasons provided by the jurisprudents who believe in intellectual ownership and concludes that Imam Khomeini,s perspective is apparently more accurate.
