عنوان فارسی تحلیل ماهیت و نظام حقوقی حاکم بر تعهدات دولت در میثاق بین‌المللی حقوق اقتصادی، اجتماعی و فرهنگی و قانون اساسی جمهوری اسلامی ایران
چکیده فارسی مقاله چکیده حقوق اقتصادی، اجتماعی و فرهنگی، امروزه بخش مهمی از حقوق قانونی بشری و شهروندی را در سطح ملی و بین‏المللی تشکیل می‏دهد که می‌توان مصادیق آن را در تخصصی‌ترین معاهده‌ی بین‌المللی در این زمینه، یعنی میثاق بین‌المللی حقوق اقتصادی، اجتماعی و فرهنگی مشاهده کرد. این حقوق در قوانین اساسی بیشتر کشورها از جمله جمهوری اسلامی ایران، وارد شده و دولت‌ها را در برابر این دست از ادعاهای شهروندان مکلف کرده است. این حقوق و تعهدات دولت نسبت به آن‌ها همواره در مقابل حقوق مدنی و سیاسی قرار می‏گیرد و از جهات مختلف با آن‌ها مقایسه می‏شود. اما بر خلاف حقوق مدنی و سیاسی، انتقادهای بسیاری با رویکردهای مختلف ایدئولوژیک، فلسفی و حقوقی به شناسایی و تضمین آن‌ها وارد و در تعهد دولت‌ها در قبال آن‌ها به شکل‌های گوناگون تردید می‌شود. مسئله‌ی این مقاله، تعیین ماهیت تعهدات دولت در مقابل این حق‏ها و تبیین رژیم حقوقی حاکم بر آن‌ها در میثاق بین‌المللی حقوق اقتصادی، اجتماعی، فرهنگی و قانون اساسی جمهوری اسلامی ایران است که به روش توصیفی و تحلیلی بررسی شده است. حاصل آنکه اگرچه ویژگی‎های ماهوی این تعهدات، آن‌ها را به تکالیفی سست بدل می‎سازد، با ساخت رژیم حقوقی محکم بر اعمال آن‌ها، می‎توان به تضمین آن‌ها قوت بخشید. با اینکه در قانون اساسی بسیاری از ویژگی‌های ماهوی این تعهدات قابل شناسایی است، به رژیم حقوقی حاکم بر آن‌ها در مقایسه با میثاق توجه کمتری شده است.

چکیده انگلیسی مقاله Abstract Economic, social and cultural rights today constitute an important part of legal human and citizenship rights which their instances may be observed in the most professional international treaty, namely the International Covenant on Economic, Social and Cultural Rights. These rights are inserted in the Constitutions of many countries, including the Islamic of Republic of Iran and have obliged the states against such claims of the citizens. These rights and the state commitments toward them are always against the civil and political rights and in different ways are compared with them. But unlike the civil and political rights, identifying and guarantee of these rights are criticized in different ideological, philosophical and legal approaches and the commitments of the states against them are doubted in various forms. The issue of this paper is to determine the nature of the state commitments against these rights and to clarify the legal regime governing them in the International Covenant on Economic, Social and Cultural Rights and the Constitution of the Islamic Republic of Iran. The research method used in this paper is descriptive and analytic. As a result, although the natural features of these commitments make them weak obligations, it is possible to strengthen their guarantee by constructing a firm legal regime to apply them. Although many substantive characteristics of these commitments can be identified in the Constitution of the Islamic Republic of Iran, the legal regime governing them is less considered in comparison with the related Covenant.
