رویکرد تفسیری شورای نگهبان به قانون اساسی در دوره‌ی نخست فعالیت |

چکیده در هر نظام حقوقی، تفسیر قوانین و بهویژه قانون اساسی برای پاسخگویی به مسائل و ابهامات پیش‌آمده در اجرای قانون، ضروری و اجتناب‌ناپذیر است؛ اما نهادهای مفسر، در طول حیات تفسیری خود همواره از رویکرد واحد تفسیری پیروی نکردهاند. این امر که مرجع صالح در تفسیر یک قانون بر اساس چه رویکرد تفسیری اقدام به تفسیر میکند، بسیار مهم است، زیرا در هر رویکرد تفسیری، ابزار تفسیری و نتیجه‌ی حاصل از تفسیر، متفاوت خواهد بود. به موجب اصل 98 قانون اساسی جمهوری اسلامی ایران، شورای نگهبان مرجع تفسیر رسمی و لازمالاتباعِ قانون اساسی است. سؤال مهمی که در این زمینه مطرح میشود این است که این شورا چه رویکردی را در تفسیر قانون اساسی اتخاذ کرده است. مقاله‌ی پیش رو در پاسخ به این پرسش، با شیوهای توصیفی- تحلیلی، بر نظرهای «تفسیری» دوره‌ی نخست فعالیت شورا متمرکز شده است. با تحلیل و بررسی نظرهای تفسیری شورای نگهبان در این دوره، می‌توان گفت هرچند این نهاد از رویکرد واحدی در تفسیر قانون اساسی متأثر نبوده، اما تأثیرپذیری وی از رویکرد متن‌گرایی و تفسیر با نظر به مدلول الفاظ قانون اساسی نسبت به سایر رویکردها بیشتر بوده است. |

The Interpretive Approach of the Guardian Council Regarding the Constitution in its First Period of Activity |

Abstract The interpretation of laws, especially the Constitution is necessary and inevitable in any legal system to settle the problems and ambiguities occurred during the implementation of the laws. But interpretive authorities have not followed a singular approach in their interpretive lives. The interpretive approach that competent authority does take in interpreting laws is very important. Because in each interpretive approach, interpretive instruments and interpretive results will be different. According to principle 98 of the Constitution of Islamic Republic of Iran, the Guardian Council is the authority for presenting official and binding interpretation of the Constitution. The noteworthy question regarding this authority of the Guardian Council is to determine the Council's interpretive approach in interpreting the Constitution. The forthcoming article through a descriptive-analytical method in order to answer this question has concentrated on the first period of the Council's activity. The findings show that although this institution in this period, has not been influenced by one particular approach in relation to constitutional interpretation, but the Guardian Council, in comparison to the other approaches, has been more affected by textual interpretation and interpreting within the words and the text of Constitution. |
