عنوان فارسی مؤلفه‌های مدل مطلوب روابط دادسرا و پلیس در نظام دادرسی کیفری جمهوری اسلامی ایران
چکیده فارسی مقاله روابط میان دادسرا و پلیس متناسب با نوع نظام دادرسی اعم از مختلط و یا ترافعی از مدل‌های متفاوت سلسله‌مراتبی و یا شبکه‌ای پیروی می‌کند. نظام دادرسی مختلطِ جمهوری اسلامی ایران، مدل سلسله‌مراتبی را در روابط دادسرا و ضابطین به کار می‌برد. بررسی‌ها حاکی از آسیب‌های ارتباطی میان دو نهاد مذکور است که موجب ضعف همکاری ضابطین با دادسرا و سستی سازمان قضایی در نیل به اهداف متعالی خود گردیده است. مقالۀ پیش‌رو، به منظورِ کاربست مدل مطلوب روابط دادسرا و پلیس در فرایند کیفری جمهوری اسلامی ایران، با استفاده از روش‌ کتابخانه‌ای، به طراحی مدل کاربردی و واقعیت‌نگر با توجه به شرایط و مقتضیات دادرسی کیفری حال حاضر پرداخته است. مدل روابط دادسرا و پلیس از منظر این پژوهش، زمانی مطلوب است که بر کارایی و اثربخشی کشف، تعقیب و تحقیق جرائم اثرگذار باشد. یافته‌ها حاکی از آن است‌ که مؤلفه‌های مدل مطلوب روابط دادسرا و پلیس ایران، عبارتند از: 1. اختصاص عملکرد کشف جرم به پلیس انتظامی، 2. هم‌سطحی نهادهای دادسرا و پلیس انتظامی و ارتباط دوسویه مبتنی بر مدل شبکه‌ای میان آن‌دو، 3. اختصاص عملکرد اجرای تحقیق به پلیس قضایی، 4. تفکیک مقام قضایی تحقیق بر اساس شدت جرائم، 5. غیرهم‌سطحی نهاد پلیس قضایی و دادسرا؛ همراه با حاکمیت منعطف و معتدل دادسرا بر پلیس قضایی.

عنوان انگلیسی Comparison of Police and the Prosecution Service Relation Models and Presenting an Optimal Model for Islamic Republic of Iran
چکیده انگلیسی مقاله The relationships between the prosecution service and the police follow distinctive models (hierarchical or network) in accordance with the ruling procedure system (accusatorial or inquisitorial). In the system of the Islamic Republic of Iran, the hierarchical model is used in the relationship between the prosecution service and the police. Studies show that there are deficiencies in the relationship between the two organizations. The present article seeks to provide an optimal model of the relationship between the prosecution service and the police in the Islamic Republic of Iran. This research has used the library methodology, and the proposed model is designed according to the existing circumstances and realities of Iran's criminal justice system and addresses its aspects. The model of prosecution service and police relations at its best situation, results in more efficiency and effectiveness in detecting, prosecuting and investigating crimes. The aspects of the optimal model for Iran's police and prosecution service relations are as follows: 1- Assignment the crime detection function to the police, 2. Two-way communication based on the network model between the two police and prosecution service and, as a result, the equality of the two organizations with each other 3. Assignment of execution of investigations to the judicial police, 4. Separation of the investigating authority based on the severity of the crimes 5. The administration of the prosecution service on the judicial police; in this way, the judicial police are established and run under the dominion of the prosecution service, and at the same time, in proportion to the circumstances, enjoy a flexible and moderate sovereignty.
