خیار شرط از دیدگاه شیخ انصاری و تطبیق بر حقوق مدنی ایران |

خیار در لغت، اسم مصدر از اختیار است. و در اصطلاح به معنی مالکیت فسخ عقد تعریف شده است. هدف از این نوشتار, بررسی خیار شرط از دیدگاه شیخ انصاری و مطابقت با حقوق مدنی می باشد. که در تهیه آن از روش تحلیلی و کتابخانه ای استفاده شده است.. با توجه به یافته های این پژوهش , شیخ انصاری معتقد است شرط کردن خیار - یعنی اختیار فسخ یا امضای معامله - در عقد موجب ثبوت حقّ خیار برای کسی میشود که این حق برای او قرار داده شده است. و همچنین معتقد است که خیار شرط به لحاظ زمان، حدّ معینی ندارد؛ بلکه هر مدت از زمان؛ کوتاه باشد یا طولانی، متصل به عقد یا منفصل از آن؛ جایز است در عقد شرط شود لکن باید معیّن باشد؛ به گونهای که احتمال کاهش یا افزایش آن نرود وگرنه هم شرط باطل است و هم معامله. شرط کردن خیار در عقد برای هریک از فروشنده و خریدار و نیز برای اجنبی به تنهایی یا همراه یکی از دو طرف عقد صحیح است. حقّ خیارشرط به سبب شرط کردن آن در عقد ثابت است. که عبارت است از تسلّط دارنده حقّ خیار بر فسخ عقد به سبب شرط کردن خیار برای خود در عقداست. شرط خیار مانند دیگر شروط در نتیجه تراضی و توافق طرفین قرارداد حاصل می شود. و اثر آن که همانا فسخ قرارداد است منوط به اراده مشروط له می باشد. |

If the option in the contract for any of the seller and the buyer as well as to foreigners alone or with one of the sides of the contract is correct.
