عنوان فارسی به شرط نتیجه بودن اعمال جراحی زیبایی غیرضروری
چکیده فارسی مقاله مباحث مسئولیت پزشک و طبیب دارای سابقه دیرینهای به عمر علم حقوق است. این مقاله با توجهبه انجام تحقیقات بسیار در خصوص اصل مسئولیت و ضمان پزشک با پیش فرضهایی مانند ضمانپزشک، لزوم اثبات تقصیر پزشک در صورت اخذ برائت و ... که بهصورت قول مشهور و رویهی قضاییدر آمده، نگاشته شده است. در این مقاله به دنبال اثبات قراردادی بودن رابطهی پزشک و بیمار دراغلب موارد میباشد. در اعمال جراحی زیبایی غیر ضروری )فانتزی( نیز پزشک، متعهد به نتیجه می-باشد و در صورت عدم حصول نتیجه، پزشک ناقض قرارداد به شمار میآید و ضامن نقض تعهدقراردادی میباشد و هیچ یک از اسباب معافکنندهی ضمانت پزشک، مانند قاعدهی احسان در اینرابطهی تجاری ورود ندارد.

چکیده انگلیسی مقاله Issues related to physician's liability is as old as the science of lawitself. This article has been written while considering abundantstudies carried out on the principle of physician's liability withpresuppositions like doctor's responsibility, the requirement toprove the doctor's failure case of obtaining innocence, etc. whichhas turned into common statement and jurisprudence. The currentstudy is trying to prove that the relation between doctor and patientis contractual in most cases. Even in unnecessary cosmetic (fantasy)surgeries, the doctor is obliged to the result; and in case of failing toobtain the [expected] result, the doctor is considered as the defiantof the contract and the guarantor of breaching the contractcommitments. No reasons exempting physician's liability sucheshesan principal cannot be enforced in this commercial relation.
