عنوان فارسی کاربرد قاعده فقهی الزام در عقود و ایقاعات
چکیده فارسی مقاله قاعده فقهی الزام هم چون سایر قواعد فقهی در نظام حقوقی ایران تأثیر گذاشته است و قانونگذار برمبنای این قاعده در بحث احوال شخصیه فتوای علمای سایر مذاهب اسلامی و ادیان آسمانی راپذیرفته است. قاعده فقهی الزام از بهترین قواعد نظم دهنده میباشد که شارع مقدس آن را به جهتراحتی و تخفیف امت اسلامی تقریر نموده است و بر طبق روایات در فقه شیعه مجرای حضور فتاوایسایر ادیان، بیشتر از موارد ذکر شده در قانون اساسی ایران میباشد، و قانونگذار میتوانست تفسیرخود را از بحث احوالات شخصیه تغییر دهد یا با بکار بردن قاعده الزام به عنوان یک ماده قانونی درمقام تنظیم روابط اقتصادی و اجتماعی میان شیعه و غیر شیعه در ابواب مختلف عقود و ایقاعات وملزم کردن سایر ادیان به اعتقاداتشان، منافع زیادی را نصیب شیعیان گرداند. آسیب شناسی اینمسئله به بسیاری از شبهات در خصوص حقوق ویژهی اقلیت های دینی در نظام حقوقی ایران پاسخخواهد داد.
