بررسی مبانی و مفاهیم حقوق آموزش عالی و تدوین اساسی ترین مسائل آن در ایران |

حقوق آموزش‌عالی شاخه‌ای از حقوق آموزش تلقی می‌شود. در این شاخه دو مبحث عمده حق آموزش‌عالی و حقوق آموزش‌عالی مطرح است. مبحث نخست زیربنای نظری حقوق آموزش‌عالی را تشکیل می‌دهد و از آن به حقوق بنیادین آموزش نیز تعبیر می‌شود. در مبحث دوم؛ یعنی حقوق آموزش‌عالی مسئله اصلی تنظیم مناسبات درونی آموزش‌عالی و همچنین، تنظیم روابط و حقوق متقابل آموزش‌عالی با دولت، شهروندان و سازمانهای دیگر مطرح است. در پژوهش حاضر در بخش نظری و مفهومی تلاش شده است تا این دو حوزه معرفی و مفاهیم اساسی آنها تبیین شود. گام دوم این پژوهش مسئله شناسی حقوق آموزش‌عالی در کشور ایران است. در این گام با اتکا به روش مطالعه اکتشافی مبتنی بر مصاحبه نیمه ساختار یافته با مدیران و خبرگان آشنا با موضوع، اساسی‌ترین مسائل و مشکلات موجود بازشناسی شده است. در پایان مجموعه‌ای از پیشنهادها برای تأسیس و توسعه حقوق آموزش‌عالی در کشور ایران و ارتقای کارایی و انسجام آن تدوین و ارائه شده است. |

Higher education law is considered as a branch of education law. This branch is posed two major concepts Higher Education Right and, Higher Education Law. The first concept is encompassed the theoretical foundation of Higher Education Law and is also interpreted as the basics of educational law as well. In the second concept, which is posed Higher Education Law, the main issue is the regulation of higher education’s internal relations and also regulation of higher education relations and mutual rights with government, citizens and other organizations. In this study on theoretical and conceptual sections is at so attempted to explain their essential introduction and concepts. The second step of this study is on problem investigation of higher education law. In this step has been recognized the most fundamental existing problems and issues by an exploration study method based on a semi-structured interview with managers and experts in this field. At the end, has been prepared and posed set of recommendations for establishing and improving the higher education laws in Iran with the approach of boosting effectiveness and solidarity of that will be mentioned. |
