چکیده فارسی مقاله چکیده مقاله حاضر، در خصوص تبیین ماهیت فقهی- حقوقی هدایای دوران نامزدی آن است. ماهیت حقوقی این هدایا، در ماده 1037 ق.م ایران، همراه با اختلاف‌نظر زیادی است که، این سؤالات را به وجود آورد: در مورد ماهیت هدایای نامزدی چه نظریه­هایی وجود دارد و از چه ایراداتی برخوردار هستند؟ چه نظریه­ای می­تواند منطبق با مواد قانونی هدایای نامزدی و موازین فقهی آن باشد؟ کوشش بر این بوده است تا نقد سازنده­ای در نظریه­های هبه مشروط، دارا شدن بلاجهت و ایقاع معلّق همراه با امتاع به عمل آید. مشخص شد، هدایای نامزدی با عقد هدیه–که وجه تمایز آن از هبه قصد اکرام داشتن و منقول بودن است- سازگاری دارد؛ و نظریه هدیه مشروط به تحقق نکاح ایرادات را مرتفع نمود؛ کما اینکه، نظریه عاریه به شرط تملیک هم خالی از پیشنهاد نیست. شایسته است، در مواد قانونی آن بازنگری‌هایی انجام پذیرد.

چکیده انگلیسی مقاله Abstract This article concerns the legal-juridical nature of engagement gifts, the legal nature of this gift is uncertain in article 1037 civil code, so this creates a lot of disagreement. This problem raises the questions about: what theories explain the legal nature of these gifts, what theories could be compatible with the articles of civil code and rules of sharia? In what matter there is the silence, ambiguity and conflicts? This article tries to critics the theories like conditional donation, unjust enrichment, It is determinated that engagement gifts is consistent with the donation contract-the difference between them is in the intention of honor and being tangible. The theory of conditional donation to the marriage responds to the criticisms. The theory of conditional borrowed could be proposed. Regarding the legal arguments in this article, this would be useful that the law is corrected or revised according the legal foundation
