عنوان فارسی مسائل کیفری جامعه در دوره مشروطیت با تکیه ‌بر اسناد عدلیه
چکیده فارسی مقاله یکی از اتفاقات مهمی که منجر به تحول در قلمروهای مختلف ازجمله ساختار حقوقی و قضایی کشور شد، انقلاب مشروطه است. این نوشتار برآن است به روش توصیفی ــ تحلیلی، چالش‌های نظام قضایی ایران در حوزه جزا را از میان منابع استخراج نماید. روح حاکم بر این ‌مطالب، نتیجه بررسی و مطالعه حجم وسیعی از اسناد تشکیلات اداری عدلیه به تعداد ده هزار برگ سند می‌باشد. این اسناد که تاکنون مورد بهره‌برداری پژوهشگران قرار نگرفته مربوط به دوره مشروطیت (1344-1324 ق/1304-1285 ش) است. با توجه به این اسناد از بررسی چالش‌های نظام قضا در دوره مشروطیت در حوزه حقوق کیفری، می‌توان چنین نتیجه گرفت که ضعف قباله‌های املاک سبب ایجاد پدیده جعل اسناد مالی و ملکی می‌شد و فقر اقتصادی در این دوره سبب بروز جرائم سرقت و راهزنی بود. از سوی دیگر با انقلاب مشروطیت، کشور ایران در نظام نوین حقوقی قرار گرفت و جرائم سیاسی و مطبوعاتی نیز موردتوجه قرار گرفت.

عنوان انگلیسی Legal issues of society during the constitutional relying on the legal documents
چکیده انگلیسی مقاله One of the main happenings which  led to the transformation in various scopes  such as the legal and juridical structure of country ,is the Constitutional revolution . This writing aims to extract the juridical challenges of Iran in the criminal scope among sources in a descriptive _analytical method method. This research was inspired by the results of examining and studying a wide range of Administrative documents of the judiciary in the number of ten thousands documents. These documents which have not been exploited by researchers so far are related to the constitutional period (1324_1344 AH, 1285_1304 SH). Considering these documents by studying the challenges of the juridical system during the constitutional in the criminal law area,it can be concluded that the land deed weaknesses caused the emergence of a phenomenon known as civil registry and financial documents forgery . Also the economic poverty in this period caused the commitment of many banditry and robbery offenses. On the other hand,by the constitutional revolution Iran was placed in a new legal system and also the press offenses were considered.
