عنوان فارسی تحلیلی بر مفهوم نهادهای زیر نظر رهبری در نظام تقنینی ایران
چکیده فارسی مقاله «نهادهای زیر نظر رهبری» عبارتی است که در بسیاری از قوانین عادی به‌کار می‌رود و عاملی برای لحاظ استثنائاتی در قوانین است. تعریف و مصادیق این عبارت ابهام دارد و اغلب تفسیری موسع از آن صورت می‌گیرد. حال آنکه شایسته است اولاً ملاک مشخصی در تعریف این نهادها اتخاذ شود تا مصادیق آن قابل احصا باشد و ثانیاً مستثنا شدن این نهادها از شمول برخی قوانین، سازوکار مشخصی داشته باشد. ملاک مجلس شورای اسلامی در تعیین این نهادها «دستگاه‌های جزء اجرایی» است که به‌نظر می‌رسد هیچ لزومی به استثنا کردن آن‌ها از قوانین، به استناد زیر نظر رهبری بودن وجود ندارد. ضمن اینکه ایرادات شورای نگهبان، دلیل اتخاذ این رویکرد توسط قانونگذار عادی است. اما ملاکی که برای تعیین این نهادها مورد تأکید نوشتار پیش روست، این است که نهادی که تمام تصمیمات آن به تأیید رهبری برسد، نهادی زیر نظر رهبری است که براساس این معیار، مستثنا شدن نهادهای زیر نظر رهبری از برخی قوانین توجیه‌پذیر خواهد بود.

چکیده انگلیسی مقاله Institutions under the supervision of the leader, is a phrase that is used in many laws and has been a cause for considering some exclusions in laws. Definition and examples of this phrase is ambiguous and often it is interpreted extensively. However, it is appropriate, firstly, to adopt specific criteria to define these institutions so as to its examples become countable and secondly excluding these institutions from the inclusion of some laws have a specific mechanism. The criterion of Majlis in determining these institutions is “executive institution” that seems there is no need to exclude them from the laws, due to being under the supervision of the leader. While the challenges of the Guardian Council, has been the cause of adoption of this approach by the ordinary legislator. The criterion that this article emphasize in determining these institutions, is that an institution that all its decisions is affirmed by the Leader, is named Institutions under the supervision of the leader. Based on this criterion, excluding these Institutions From some laws would be justifiable.
