سیاست جنایی قضایی غیرکیفری در حمایت از منابع طبیعی |

اهمیت پرداختن به موضوع حمایت از منابع طبیعی از جمله اراضی ملّی با توجه ماهیت و آثار و عوارض آن خصوصاً در جامعه ایرانی، با توجه سرعت تخریب و تهدید علیه منابع طبیعی یکی از اولویت‌های مورد بررسی در حوزه سیاست جنایی قضایی می‌تواند باشد. همچنین با توجه به بیان مقام معظم رهبری (مدظله) که بر پیشگیری در حوزه‌ی منابع طبیعی از جمله زمین‌خواری، تخریب جنگل‌ها و نظایر آن تأکید فرمودند می‌توان به ضرورت و اهمیت تحقیق پی‌برد. پژوهش حاضر از لحاظ هدف جز تحقیقات کاربردی و مسأله محور است و نوع تحقیق توصیفی و تحلیلی می‌باشد. از آن جهت که درمقام بررسی و ارائه راهکار برای یک مسأله اجتماعی تحت عنوان سیاست جنایی قضایی درحوزه حمایت از منابع طبیعی است به دنبال بیان معایب و نواقص در این حوزه می‌باشیم. از این‌رو با بررسی پیشگیری اجتماعی و وضعی در حوزه‌ی حمایت از منابع طبیعی و ملّی اولاً: می‌خواهیم مشخص نماییم که تا به امروز در حوزه‌ی منابع طبیعی و ملّی چه اقدامی قضایی در بعد غیرکیفری صورت پذیرفته است که به نظر می‌رسد باید در این خصوص اهتمام جدی شود تا به بازدارندگی و پیشگیری از جرایم این حوزه دست یافت دوماّ: به ارئه و بیان خلاءها و نواقص در این موضوع بپردازیم. همچنین پیشنهاد می‌شود تمام دستگاه‌ها با تدابیر و سیاست‌های قضایی مناسب و علمی با مشارکت سازمان‌ها در جهت نهادیه کردن فرهنگ حمایت از منابع طبیعی کوشید. |

Because we are considering and presenting a solution to a social issue called the criminal justice policy in the field of protecting natural resources, we are looking for the disadvantages and deficiencies in this area. Hence, by studying social prevention and status in the area of protecting natural and national resources. Firstly, we want to determine what judicial action has been taken in the area of natural and national natural resources in the field of non-refoulement, which seems to be a serious concern in this regard. To prevent and prevent crime in this area. Secondly, we will address the issues of deficiencies and deficiencies in this area. It is also suggested that all devices, with the appropriate legal and scientific policies and practices, cooperate with NGOs to institutionalize the culture of protecting natural resources. |
