چکیده فارسی مقاله فقیهان در مورد مشروعیت حقوق مالکیت فکری اختلاف نظر دارند. به نظر برخی فقیهان این گونه حقوق به دلایلی چون ناسازگاری آن با قاعده سلطه، عدم امضای چنین حقوقی از سوی شارع، ناسازگاری آن با رسالت و قداست علم و غیر قابل تملک شخصی بودن این دسته از حقوق، حقوقی شرعی محسوب نشده و اشخاص ثالث می‌توانند بدون اجازه صاحبان اثر در آن تصرف کنند. به نظر برخی دیگر، چنین حقوقی شرعیت داشته و تصرف در آنها بدون اجازه صاحبان آنها جایز نیست. ادله این گروه عبارتند از: بنای عقلا، قاعده سلطه، حرمت تصرف در اموال دیگران بدون اجازه آنها، قاعده لاضرر، راهکار ولایت فقیه، مصالح مرسله و سدّ ذرایع که دو دلیل اخیر اختصاص به فقه اهل سنّت دارد.

چکیده انگلیسی مقاله There are differences of opinion among the jurists about legality of intellectual property rights.  Some jurists maintain that such rights are not legal due to the following reasons: their incompatibility with the rule of domination, lack of acknowledgement of such rights by the Law-Giver, their incompatibility with the mission and sanctity of science and lack of personal possession. Hence, they maintain that third persons can use them with any permission from the proprietors. Some other jurists maintain that such rights are legal and that one should not use them with the permission of the proprietor. They argue that the following reasons support their viewpoints: reason, rule of domination and Wilayat  Faqih. The Sunni jurists also forward two reasons in support of this viewpoint.
