عنوان فارسی واکاوی بحث صحیح و أعم با رویکردی بر نظر امام خمینی(س)(۲)
چکیده فارسی مقاله : پس از آنکه در بخش نخست[1] از مقاله «واکاوی بحث صحیح و اعم با رویکردی بر نظر امام خمینی(س)» نه مقدمه از مقدمات دوازده‌گانه بحث صحیح و اعم (شامل تبیین مسأله و ذکر کلیات بحث صحیح و اعم، ترسیم محل نزاع در صحیح و اعم، تبیین چیستی معنایی صحیح و فساد و بیان مراد از صحت و شرایط آن، وجه تسمیه و نامگذاری الفاظ، لزوم تصویر قدر جامع و ...) بیان شد، در مقدمه دهم آن اشاره شد که تصویر قدر جامع ــ چه صحیحی باشیم و چه اعمی ــ لازم است؛ لذا در بحث کاملی تصویر قدر جامع طرح و بیان شد که سیزده مبنا در مورد قدر جامع متخذ شده، که این مبانی در دو وجه مورد بررسی قرار می‌گیرند: وجه اول که تصویر قدر جامع از منظر صحیحی‌ها و پنج مبنا می‌شد، در بخش نخست مقاله طرح گردید و اینک در بخش دوم مقاله، وجه دوم از نظرگاه اعمی‌ها که شامل هشت مبناست، تبیین می‌گردد؛ در پایان مقدمه دهم بیان می‌شود از میان این سیزده مبنا، چهار مبنا را می‌توان ثبوتاً پذیرفت، که عبارتند از: مبنای آخوند، مبنای محقق اصفهانی (از میان صحیحی‌ها) و مبنای امام خمینی (با تصحیحی که در آن ارائه می‌شود) و مبنای مختار از میان اعمی‌ها. در مقدمه یازدهم، ثمرات بحث صحیح و اعم مطرح می‌شود و در نهایت در مقدمه دوازدهم چهار قول متخذ در مورد وضع الفاظ برای صحیح یا اعم بیان می‌گردد؛ پس از طرح این مقدمات دوازده‌گانه، وارد تقریر ادله صحیحی‌ها و سپس اعمی‌ها شده و در جمع بندی ادله باب بیان می‌گردد که: «در بحث صحیح و اعم، یک مبنای عام نداریم، بلکه درباره هر عنوان فقهی (از قبیل وجوب، حرمت، صوم، حج و ... حتی در افعال) باید به طور مستقل بررسی صورت پذیرد، و با توجه به گستردگی عناوین مذکور، بحث هر عنوان را باید در آغاز باب فقهی خود، مطرح ساخت».   [1سید.

عنوان انگلیسی A Study of the Issue of Correct and General With Special Reference to Imam Khomeini’s Viewpoint
چکیده انگلیسی مقاله In the first part of this article nine preludes of the twelve preludes of the issue of correct and general (including explanation of the problem, its overview, the problematic, its nature, its nomenclature, and the necessity of depiction of limit of comprehensive), were discussed. It was mentioned in the tenth prelude that it is necessary to depict the limit of general whether as a generalist or correctist. Hence, in the generalist approach, the nature of limit of general was discussed and was mentioned that thirteen principles were extracted with regard to the limit of general. These principles are studied within the framework of two approaches: First approach includes the limit of general in viewpoint of correctness which has five bases. The first approach that is the limit of general from the viewpoint correctists and has five principles was discussed in the first part of the article. In this part, the approach of generalists which has eight principles is discussed. At the end of the tenth principle it is argue that out of the thirteen principles four can be accepted proven which are those offered by Akhund, Mohaqeq Isfahani (a correctist), Imam Khomeini (as a correctist) and Mokhtar as a generalist. In the eleventh prelude, the results of both approaches are discussed and finally in the twelfth prelude four arguments on the concept of correct or general are discussed. In the next step the reasons of the correctists and generalists are concluded: we don't have a general principle with regard to the issue of correct and general, rather each jurisprudential issue (such as obligatory, prohibition, fast, Hajj, and even deeds) should be studied independently and given the wide scope of the said issues, the discussion of each issue must be given within the framework of its jurisprudential chaptery
