عنوان فارسی تشخیص معیار تبعیت در عقود تبعی و آثار آن در حقوق ایران، فرانسه و انگلیس
چکیده فارسی مقاله چکیده در این مقاله سعی شده معیار حقوقی تبعیت عقود تبعی از تعهد پایه، در حقوق ایران شناسایی شود تا از این طریق، حدود تبعیت در عقود تبعی و مبنای آن مشخص گردد. در همین راستا، به دو نظریه عمده درخصوص مبنای تبعیت اشاره شده است: نظریات تبعیت ذهنی و تبعیت عینی. مطابق نظریه تبعیت ذهنی، علت و مبنای تبعیت عقد تبعی از تعهد پایه آن است که طرفین عقد، این تبعیت را خواسته اند. بنابراین، حدود و آثار این تبعیت را نیز اراده ایشان مشخص می سازد. در مقابل، مطابق نظریه تبعیت عینی، علت تبعیت عقد تبعی از تعهد پایه آن است که تعهد پایه، موضوع عقد تبعی قرار گرفته و این رابطه عینی و مادی بین عقد تبعی و تعهد پایه، باعث تبعیت کامل عقد تبعی از اوصاف و وی‍ژگی¬های تعهد پایه می¬گردد. تعیین نظریه قابل پذیرش در حقوق ایران، دارای آثار متعددی است که مورد اشاره قرار خواهد گرفت.

عنوان انگلیسی Determination of Criteria of Accessority and Its Effects in Accessory Contracts in Iranian, French and English Law
چکیده انگلیسی مقاله This article, to determine aimed the criteria and basis of accessority of accessory contracts in relation to basic obligation, in order to determine the limits and basis of accessority. In this respect, two main theories were considered; theory of subjective accessority and theory of objective accessority. According to the subjective theory, the basis of accessority of accessory contract in respect of basic obligation is the will of the parties. Consequently, this would determine the limits and effects of this accessority. On the other hand, according to the objective theory, the basis of accessority of accessory contracts could be found in this fact that the basic obligation is the subject of the accessory contracts. This material relationship between the accessory contract and the basic obligation results in complete accessority of the accessory contracts from the characteristics of basic obligation. Determination of the accessority criteria would justify different effects and characteristics of the accessory contracts, which will be discussed.
