عنوان فارسی بررسی تفاوت مسائل اصولی و قواعد فقهی
چکیده فارسی مقاله هر یک از بزرگان علم اصول، با تمرکز بر نکته‌ای سعی کرده‌اند که تمایزی  را بین قواعد فقهی و مسائل اصولی پیدا کنند. مرحوم آخوند با تکیه بر میزان شیوع این مسائل در «ابواب فقهی»، مرحوم خویی با توجه به «حکمیه» یا «موضوعیه» بودن شبهه در یکی از نظریات خود و عنایت به تفاوت «استنباط» و «تطبیق» در نظریه دیگر، مرحوم حکیم با پیش کشیدن «توقف هر یک از مسائل بر دیگری و عدم آن»، مرحوم نائینی با موضوعیت دادن به میزان انتفاع «مجتهد» و «مقلد» از این مسائل در نظریه اول و ملاک قرار دادن «کلی» یا «جزئی» بودن نتیجه حاصله در نظریه دوم، و در آخر مرحوم امام با طرح «آلی» یا «استقلالی» بودن مسائل، سعی در حل این مسائل داشتند. از میان این نظریات، تنها مبنای مرحوم آخوند و حضرت امام می‌تواند راه حل جامع برای حل این مهم باشد.

چکیده انگلیسی مقاله   Great experts of principles of jurisprudence have tried to make a distinction between jurisprudential rules and issues related to principles of jurisprudence. The following jurisprudents tried to solve this problem through different approaches; the late Akhund relied on the prevalence of such issues in jurisprudential chapters, the late Khoie tried to make a distinction between commandments and subjective nature of these issues and also between inference and adjustment, the late Hakim focused on dependability of one subject on another or their independence from each other, the late Naini focused on usefulness of these issues for the religious authority and the followers as well as the generality or particularity of the result therein; the late Imam focused on the independence of the issues.  Among the said issues, only the viewpoints of Imam Khomeini and the late Akhund can be used as a comprehensive solution to the problem.
