عنوان فارسی آنالیز ابزار اصولی «بنای عقلا» به روش «بررسی مؤلفه‌های واژه‌های آن و تحلیل کاربردها و ارتکازات»
چکیده فارسی مقاله بنای عقلا ابزاری اصولی است، که از یک سو اضلاع و مؤلفه‌های آن در اصول واکاوی نگردیده است و از سوی دیگر سازوکار تحصیل آن، برای استفاده از آن در فقه، ارائه نگردیده است. در این مقاله با بررسی تعاریف موجود از بنای عقلا، و تحلیل کاربردهای آن در فقه و اصول، این ابزار اصولی مورد مداقه قرار می‌گیرد و پس از کشف اضلاع و مؤلفه‌های آن، و تبیین تفاوت آن با «اتفاق العقلاء»، به بررسی سازوکارهای به کاربرده شده در فقه و اصول برای تحصیل آن می‌پردازد، و در نهایت سازوکار استناد به بنای عقلا در فقه و یا اصول، پیشنهاد می‌گردد.

چکیده انگلیسی مقاله Intellectuals’ stipulation is a principled instrument, that on one hand its sides and components have not been explored into in principles and on the other hand the mechanism of its acquisition to be used in jurisprudence has not been provided. In this article, with an examination of the definitions available about intellectuals’ stipulation and analysis of its application in jurisprudence and principles, this principled instrument will be scrutinized and after uncovering its sides and components and explaining its difference with “intellectuals’ unanimity”, the mechanisms employed in jurisprudence and principles for acquiring it will be examined and finally the mechanism for relying on intellectuals’ stipulation in jurisprudence and principles will be suggested.
