عنوان فارسی بررسی خیار غبن و رابطه آن با قاعده لاضرر با رویکردی بر اندیشه امام خمینی (س)
چکیده فارسی مقاله این نوشتار پیرامون ماهیت خیار غبن و رابطه آن با قاعده لاضرر است. ابتدا به صورت کلی تعریف خیار غبن و شرایط تحقق این خیار را مطرح می‌کند و در ادامه اختلاف نظر فقها در مورد مدرک خیار غبن را بررسی می‌کند. فقها مدارک متعددی را برای خیار غبن ذکر کرده اند که با توجه به اشکالات وارد شده به هر مدرک، در نهایت تخلف از بنای عقلا و شرط ضمنی به عنوان مدرک پذیرفته می‌شود. در خاتمه بحث به رابطه خیار غبن و قاعده لاضرر پرداخته می‌شود و بیان خواهد شد که قاعده لاضرر نمی‌تواند مدرک و مبنای این خیار باشد. در راستای انجام این پژوهش آرای فقها به خصوص امام خمینی مد نظر قرار گرفته است.

عنوان انگلیسی A Study of the Right to Rescind the Contract in Case of Loss Resulting from Deceit and Its Relation with the Principle of No Harm, with Emphasis on Imam Khomeini’s Viewpoints
چکیده انگلیسی مقاله The main objective of the present research is tostudy the Right to Rescind the Contract in Case of Loss Resulting from Deceitand its relation with the Principle of No Harm. In the first place the right torescind a contract in case of loss resulting from deceit and conditions for itsrealizations are defined and then the viewpoints of the jurisprudents about thedocument of this rule are discussed. The jurisprudents have employed differentsources for this rule. These documents have been critically studied and finallyit is concluded that rationality and stipulation are accepted as a document ora basis for this rule. Also the relationship between the Right to Rescind theContract in Case of Loss Resulting from Deceit and the Principle of No Harmhave been discussed, arguing that the Principle of No Harm cannot be a basis ora source for this option. The viewpoints of jurisprudents, particularly thoseof Imam Khomeini, have been taken into consideration in this research
