عنوان فارسی بررسی تطبیقی خطابات شرعی از دیدگاه مشهور و امام خمینی(س)
چکیده فارسی مقاله از مهم­ترین نوآوری­های علمی و اصولی امام خمینی که برخوردار از دقایق و ظرایف علمی بسیار زیاد بوده و آثار فراوانی نیز در مباحث فقهی و اصولی داشته، مسلک خطابات قانونی است که مطابق این نظریه، خطابات شرعی بدون ملاحظه خصوصیات فردی مانند عجز و قدرت، متوجه همه مکلفان می­گردد و به خطاب­های متعدد به اندازه مکلف­ها نیز منحل و گسترده نمی­شود. این نظریه، دقیقاً در تقابل با دیدگاه مشهور فقها و اصولیان، همانند شیخ انصاری، محقق نائینی و محقق خویی در لحاظ شرایط تکلیف مانند عقل و قدرت، در توجه خطاب و انحلالی بودن احکام شرعی به عدد افراد مکلف است. در این پژوهش، به بررسی تطبیقی این دو نظریه پرداخته و بدین نتیجه رسیده­ایم که نظریه خطابات قانونیه، با استحکام مبنایی روبرو بوده و از پشتوانه استدلالیِ قوی نیز برخوردار است و از این رو، نظریه امام خمینی، مبنی بر عدم انحلالی بودن احکام، تقویت و اشکالات وارده به آن دفع می‌گردد.

عنوان انگلیسی A Comparative Study of Legal Addresses by Imam Khomeini and Generally Accepted Viewpoints
چکیده انگلیسی مقاله Legal addresses theory is one of the mostimportant scientific and fundamental innovations by Imam Khomeini which isenriched with many scientific values and points and has immensely affected thejurisprudential and theological discussions. According to this theory, legaladdresses, irrespective of personal qualities and capacities such as inabilityand power, shall be practiced by all bearing responsibility and it is notconsidered independent with the diversity of the addresses per the number ofthose in charge. This theory precisely counters the generally accepted views ofrenowned jurists and theoreticians of religious law such as Sheikh Ansari,Ayatollah Nayini, and Ayatollah Khoyi in inclusion of the preconditions forundertaking the religious duty such as wisdom and power, and in independence ofthe religious rules per the number of all under religious duty. In this paper,we have conducted a comparative study of the two theories and came to theconclusion that the legal addresses theory is fundamentally secure, possessingvery strong bases for reasoning. Therefore, Imam Khomeini’s views on noindependence for religious rules, is thus supported and the alleged faults withit are rejected
