عنوان فارسی ضرورت‌سنجی پیوست تحلیل اقتصادی موضوع قانون به مثابه لازمه قانونگذاری اثربخش
چکیده فارسی مقاله قانونگذار همواره در اجرای وظیفه قانونگذاری خود با محدودیت‌‌هایی مواجه است. این در شرایطی است که هم‌زمان تحت فشارهای سیاسی و اجتماعی، مانند مطالبات مردم و درخواست‌های ذی‌نفعان حزبی، قرار دارد. مرور کمّی و کیفی طرح‌ها و لوایح واصله و تعداد پیشنهادهای قانونی مصوب در دوره‌های دوازده‌گانه مجلس شورای اسلامی مؤیّد این موضوع است. در چنین شرایطی قانونگذار ناگزیر است از میان موارد متعدد دست به انتخاب بزند. در این انتخاب، قانونگذار مؤلفه‌های بینابینی متعددی برای گذر از چالش‌های سیاسی‌ـ اجتماعی در نظر می‌گیرد. این شرایط می‌تواند تحقق قانون اثربخش را با چالش روبه‌رو کند. بررسی این امر موضوع پژوهش حاضر است. قانون اثربخش قانونی است که در پرتو تحلیل اقتصادی و از طریق در نظر گرفتن هزینه‌ـ فایده مصوب شود. به عبارت دیگر این پژوهش با نگاهی به نیازهای قانونی جامعه مبحث اولویت‌بندی موضوعات قانون و استفاده بهینه از منابع به منظور دستیابی به قانونگذاری اثربخش در نظام تقنینی ایران را مورد بررسی قرار می‌دهد.
به این منظور، با استفاده از مدل بازار قانون، از ابزارهای اقتصادی برای تحلیل نحوه انتخاب موضوعات قانونی استفاده می‌شود. از جمله تأثیر قیمت‌گذاری (هزینه‌های اجرای قانون) و کشش تقاضا بر رفتار مصرف‌کنندگان قانون (شهروندان)، هزینه‌ـ فرصت رسیدگی به موضوعات قانونی، کارایی قوانین، عقلانیت در انتخاب موضوعات مورد بررسی قرار می‌گیرد.
نتایج تحقیق نشان می‌دهد شناسایی نیازهای واقعی جامعه و اولویت‌بندی آن‌ها در انتخاب موضوعات قانونی کلید کاهش هزینه‌های قانونگذاری و استفاده از منابع در موضوعاتی است که بیشترین بازدهی و اثربخشی را دارد. این پژوهش، که با رویکرد توصیفی‌ـ تحلیلی و با استفاده از روش کتابخانه‌ای چالش‌های انتخاب موضوعات قانونی را با استفاده از مؤلفه‌های اقتصادی بررسی می‌کند، می‌تواند به قانونگذاران و مراکز پژوهشی تقنینی در انتخاب موضوعات قانونی با اولویت‌بندی صحیح و بهینه‌سازی منابع یاری رساند و به کاهش هزینه‌های قانونگذاری و افزایش اثربخشی آن دست یابد..

عنوان انگلیسی The Necessity of Conducting an Economic Analysis Attachment for the Subject of Law; as a Prerequisite for Effective Legislation
چکیده انگلیسی مقاله The legislator is always faced with limitations in carrying out their legislative duties; this occurs while simultaneously under pressure from political and social forces such as public demands and requests from party stakeholders. A quantitative and qualitative review of the bills and proposals submitted, as well as the number of approved legal proposals during the twelve terms of the Islamic Consultative Assembly, confirms this issue. In such circumstances, the legislator is compelled to make choices among multiple options. In this selection process, the legislator considers various intermediary factors to navigate political and social challenges; these conditions can pose a challenge to the realization of effective law. Examining this matter is the subject of the present research. An effective law is one that is enacted in light of economic analysis and through consideration of cost-benefit aspects. In other words, this research, with a focus on the legal needs of society, addresses the prioritization of legal topics and the optimal use of resources to achieve effective legislation within the Iranian legislative system.
To this end, using the legal market model, economic tools are employed to analyze how legal topics are selected. This includes examining the impact of pricing (the costs of law enforcement) and demand elasticity on the behavior of law consumers (citizens), the opportunity costs of addressing legal issues, the efficiency of laws, and the rationality in selecting topics.
The research findings indicate that identifying the actual needs of society and prioritizing them in the selection of legal topics is key to reducing legislative costs and utilizing resources on issues that yield the highest returns and effectiveness. This research—conducted with a descriptive-analytical approach and utilizing library methods—examines the challenges of selecting legal topics using economic components and can assist legislators and legislative research centers in prioritizing legal topics correctly and optimizing resources, thereby reducing legislative costs and increasing its effectiveness.
