عنوان فارسی اختلاف در صلاحیت بین دادگاه‌‌ها و مراجع غیر قضایی
چکیده فارسی مقاله به موجب ماده 28 ق.آ.د.م.: «... در مواردی که دادگاه‌‌ها اعم از عمومی، نظامی، و انقلاب به صلاحیت مراجع غیر قضایی از خود نفی صلاحیت کنند و یا خود را صالح بدانند، پرونده برای حل اختلاف به دیوان عالی کشور ارسال خواهد شد ...». مطابق رأی وحدت رویه شماره 660 مورخ 19/01/1382 هیئت عمومی دیوان عالی کشور نیز در مواردی که دادگاه‌‌ها به صلاحیت مراجع غیر قضایی از خود نفی صلاحیت کنند یا خود را صالح بدانند، نیازی به حدوث اختلاف نیست و پرونده مستقیم برای تشخیص صلاحیت به دیوان عالی کشور ارسال می‌شود. حکم و عبارت ماده 28 ق.آ.د.م. در بخش مربوط به تعارض در صلاحیت بین دادگاه‌‌ها و مراجع غیر قضایی و رأی وحدت رویه مربوط به آن از جهات متعدد قابل تأمل و قابل انتقاد است. بررسی موضوع نشان می‌دهد حکم ماده یادشده و رأی وحدت رویه مربوط به آن در قسمتی اشتباه و در قسمتی منطقی نیست و اصلاح قانون در این زمینه ضروری است.

چکیده انگلیسی مقاله According to Article 28 of the Civil Procedure Code: "... in cases where the courts, including general, military, and revolutionary, deny themselves jurisdiction over the jurisdiction of non-judicial authorities or consider themselves competent, the case for dispute resolution will be sent to The Supreme Court..." According to the Unanimity decision No. 660 of the Supreme Court General Board, in cases where the courts deny themselves jurisdiction over the jurisdiction of non-judicial authorities or consider themselves competent, there is no need for a dispute; rather, the case is to be sent directly to the Supreme Court. The phrasing of Article 28 of the Civil Procedure Code, particularly regarding the conflicts in jurisdiction between the courts and non-judicial authorities, and the unanimous decision related to it, it can be considered and criticized in many ways. Upon examination, it appears that both the mentioned article and the unanimous decision contain elements that are partly erroneous and partly unreasonable, and it is necessary to amend the law in this regard.
