عنوان فارسی واکاوی تحلیلی تأثیر قواعد منطقی در گزاره‌های اصولی
چکیده فارسی مقاله تأثیر بسزای مسائل و قواعد منطقی در گزاره‌های اصولی و عملیات استنباط احکام شرعی پوشیده نیست تا آنجا که مباحث منطقی از مبادی علم اصول و از مبادی اجتهاد شمرده شده است.
بسیاری از اصولیان با تصریح خود و یا با بهره‌گیری عملی از قواعد منطقی در استدلال‌های خود، عملاً به تأثیر استفاده از دانش منطق در استنباط احکام تن داده‌ و در مقابل، عده‌ای نیز منکر کاربرد این علم در مسیر استنباط احکام بوده و برخی آن را از مصادیق خلط حقیقت و اعتبار دانسته‌اند.
در این نوشتار به‌هدف تقویت جایگاه عقل در اجتهاد، ابتدا رابطهٔ علم منطق با اصول‌ فقه را تبیین نموده و با رویکرد ‌توصیفی‌تحلیلی به پیشینۀ تاریخی تداخل مسائل علم منطق با علم اصول فقه پرداخته و پس از بیان مبادی منطقی علم اصول، دیدگاه اصولیان را در خصوص جایگاه دانش منطق به‌عنوان یکی از مبادی اجتهاد مورد واکاوی قرار داده‌ایم و ضمن پاسخ‌گویی به شبهات، با اشاره به نمونه‌هایی از کاربرد مباحث و قواعد منطقی در گزاره‌های اصولی و عملیات استنباط احکام فقهی، توقف اجتهاد بر فراگیری اکثر قواعد و مصطلحات علم منطق را اثبات نموده‌ایم.

عنوان انگلیسی An Analytical Investigation of the Impact of Logical Principles on Propositions of Principles of Jurisprudence
چکیده انگلیسی مقاله The significant impact of logical principles and issues on the propositions of principles of jurisprudence, and on the process of deducing legal rulings is apparent to everyone, to the extent that logical discussions are considered as foundational elements in the knowledge of principles of jurisprudence (ʾUṣūl) and in ʾIjtihād.
Many ʾUṣūlīs have acknowledged the impact of using logical principles in the process of deducing rulings, either explicitly or by practically employing logical principles in their deductions. Conversely, some have denied the usage of this field in deducing rulings, and some have considered it as an instance of conflating reality and credibility.
The present study aims at reinforcing the role of reason in ʾijtihād. In doing so, first, the relationship between the science of logic and ʾUṣūl al-fiqh is clarified, and the historical background of the overlap between the two is explored using the descriptive-analytical approach. After presenting the logical foundations of ʾUṣūl al-fiqh, we analyze the opinions of ʾUṣūlīs regarding the status of the science of logic as one of the foundations of ʾijtihād. In addition to resolving some doubts, we prove that the process of ʾijtihād requires a mastery of the majority of principles and the technical terminology of the science of logic. This is done using some examples of the application of logical discussions and principles in propositions of principles of jurisprudence and the process of deducing jurisprudential rulings.
