عنوان فارسی نظارت‌ اداری و فرایند پردازش‌اطلاعات شبکه‌های ‌ارتباطی با هدف حفظ حقوق اشخاص موضوع‌داده
چکیده فارسی مقاله نظارت ‌اداری به معنای ایجاد چارچوبی در جهت حفظ ‌نظم‌عمومی و اجرای حقوق و آزادی‌هاست. یکی از مصادیق حفظ ‌نظم‌ عمومی پیشگیری ‌از نقض ‌امنیت پردازش ‌اطلاعات در شبکه‌های ‌ارتباطی می‌باشد. فرایند پردازش‌ اطلاعات با توجه به گستردگی و حساسیت خود، الزاماتی را ایجاب می‌نماید تا در محدوده آنها، امنیت این فرایند حفظ گردد. از جمله این الزامات پیش‌بینی حقوقی برای اشخاص‌ موضوع‌‌داده می‌باشد تا با اجرای آنها از نقض‌امنیت داده‌پیام‌های خود پیشگیری نمایند. سؤال اصلی که این پژوهش به دنبال پاسخگویی به آن می‌باشد اینست که حقوق قانونی این اشخاص در فرایند پردازش‌ اطلاعات چیست؟ برای پاسخ به این سؤال، پژوهش حاضر به روش اسنادی و مطالعه نظام ‌حقوقی اتحادیه ‌اروپا حقوق اشخاص ‌موضوع‌داده در این نظام را که متشکل از چهار حق اصلی دسترسی، پاک‌کردن، محدودیت پردازش و اعتراض به پردازش ‌اطلاعات می‌باشند و امکان‌سنجی تطابق آن با مقررات مصوب در نظام ‌حقوقی ایران را بررسی و در نهایت مبادرت به ارائه پیشنهادات سیاستگذارانه در جهت تدوین قوانین جدید یا اصلاح قوانین موجود می‌نماید.

عنوان انگلیسی Administrative police and information processing process of communication networks with the aim of protecting the rights of data subjects
چکیده انگلیسی مقاله Administrative Police means creating a framework for maintaining public order and enforcing rights and freedoms. One of the examples of maintaining public order is the prevention of information processing security violations in communication networks. The process of information processing, due to its breadth and sensitivity, requires requirements to maintain the security of this process within their limits. Among these requirements is the provision of legal provisions for data subjects to prevent data security violations of their messages by implementing them. The main question that this research seeks to answer is what are the legal rights of these people in the information processing process? In order to answer this question, the current research is based on documentary method and studies the legal system of the European :union:, the rights of individuals in this system, which consist of the four main rights of access, erasure, restriction of processing and objection to the processing of information, and the feasibility of its compliance with the regulations approved in the Iranian legal system, examines and finally initiates the presentation of policy proposals for the development of new laws or the amendment of existing laws.
