عنوان فارسی واکسیناسیون اجباری به مثابه تضمین سلامت در محیط کار: بررسی حقوقی اسناد داخلی و بین‌المللی
چکیده فارسی مقاله بیماری کرونا حیات جوامع توسعه‌یافته و در حال توسعه را به لرزه درآورد و با ایجاد آثار سهمگین و جبران ناپذیر، ابعاد مختلف زندگی فردی و اجتماعی شهروندان را تحت تأثیر خود قرار داد. در حالی که همگان برای دستیابی به درمان بیماری لحظه‌شماری می‌کردند، رونمایی از واکسن‌های تولید شده با مجوز اضطراری، زمینه‌ساز مباحث مختلف اجتماعی و حقوقی شد. در ایران و طبق مصوبه ستاد کرونا، کارکنان دولت در کنار گروه‌های دیگری از مردم ملزم به تزریق واکسن شدند و عدم حضور در محل کار به عنوان مجازات مستنکفین تعیین شد.صرف نظر از آثار این تصمیم بر بهداشت و سلامت عمومی، اعتبار حقوقی آن نیز محل بحث اندیشمندان علم حقوق واقع شده است و بیان موضع هر دو ساحت حقوق داخلی و حقوق بین المل بشر نسبت به واکسیناسیون اجباری، می تواند بر اقناع شهروندان و تمکین یا تمرد از انجام آن اثرگذار باشد. مسئله محوری پژوهش پیش رو، ارزیابی الزام به واکسیناسیون ذیل مقررات و نظامات حقوق ایران و حقوق بین الملل بشر است. با تکیه بر منابع کتابخانه‌ای و در روشی توصیفی–تحلیلی این نتیجه به دست آمد که طبق قوانین و مقررات کشور، الزام به واکسیناسیون و به ویژه پیش‌بینی مجازات در صلاحیت مجلس شورای اسلامی است و طبق منشور حقوق بیمار، ستاد کرونا و ارکان اجرایی وابسته، ملزم به اطلاع‌رسانی در باب واکسن و عوارض آن و پایش وضعیت سلامت افراد حین و پس از تزریق بوده‌اند. در حقوق بین‌الملل نیز امکان الزام‌آور ساختن شیوه درمانی مشخص چون واکسیناسیون ذیل حق بر سلامت و به منظور تضمین حق حیات افراد در شرایط شیوع بیماری‌های همه‌گیر وجود دارد. به‌علاوه اگر چه این الزام با حق بر حریم خصوصی شهروندان (بعد تمامیت جسمانی) در تضاد است لکن حقوق بین‌الملل زمینه ایجاد محدودیت بر حقوق فردی به جهت تضمین سلامت عمومی را مشروط به رعایت شرایطی چون تناسب و ضرورت فراهم نموده است.

عنوان انگلیسی COMPULSORY VACCINATION OF GOVERNMENT EMPLOYEES IN THE LIGHT OF DOMESTIC AND INTERNATIONAL LAW
چکیده انگلیسی مقاله Covid-19 disease has shocked the lives of developed and developing societies and has affected various aspects of individual and social life of citizens by creating devastating and irreparable effects. While everyone was counting down the hours to get treatment for the disease, the unveiling of emergency-licensed vaccines sparked a variety of social and legal issues. In Iran, according to the decision of the National Corona Management Headquarters, government employees along with some other groups of people were obliged to be vaccinated, and absenteeism was the punishment of deniers. Consequently, legal validity of these enactments has also been discussed by scholars. Clarifying the position of domestic law and international human rights regarding mandatory vaccination can have an effect on persuading citizens and whether or not to do vaccination. central issue of the following research is the evaluation of compulsory vaccination according to the provisions of Iranian law and the rules of international human rights. Based on library resources and in a descriptive-analytical method, it was concluded that according to the laws and regulations of Iran, the obligation to vaccinate and in particular the provision of punishment is within the competence of the Parliament and according to the Charter of Patients' Rights They were required to provide information about the vaccine and its effects, and to monitor the health status of individuals during and after the injection. In international law, it is also possible to make specific treatments mandatory, such as vaccinations under the right to health, in order to guarantee the right to life in the event of an epidemic. In addition, although this requirement conflicts with citizens' right to privacy, international law provides for restrictions on individual rights to ensure public health, subject to conditions such as appropriateness and necessity.
