عنوان فارسی تحلیلی بر چالش‌های قراردادهای بالادستی نفت و گاز جمهوری اسلامی ایران
چکیده فارسی مقاله به دلیل وجود منابع عظیم نفت و گاز در ایران، صنعت نفت و گاز نقش عمده­ای در اقتصاد کشور ایفا می­کند. کشور ما علیرغم بیش از یک قرن تجربه در حوزه قراردادهای نفتی هنوز نتوانسته ضعف­های خود را در این حوزه برطرف کند که این امر ناشی از مسائل گوناگونی همچون ملاحظات سیاسی، اقتصادی، اجتماعی، اداری، حقوقی، تاریخی و فرهنگی است. ایران نیز مانند سایر کشورهای درحال توسعه معمولاً از کمبود سرمایه و دانش فنی کافی و مناسب و همچنین توان مدیریتی مطلوب به منظور اجرای طرح­های بزرگ نفتی بالادستی در زمینه­های اکتشاف، حفاری، توسعه و تولید رنج برده است؛ بنابراین حضور شرکت­های بین­المللی مجرب در این عرصه اجتناب­ناپذیر به‌نظر می­رسد که این امر مستلزم انعقاد قراردادهای همکاری با این شرکت­های نفتی بین­المللی می­باشد. بر این اساس، در این تحقیق پس از تشریح مفاهیم اساسی موضوع پژوهش، به منظور ارزیابی چالش­های این حوزه، الزامات و محدودیت­های قانونی حاکم بر قراردادهای بالادستی نفت و گاز، مورد بررسی قرار گرفته است. در ادامه، 26 چالش مهم‌تر از میان 40 چالش­ شناسایی­شده مستخرج از پیشینه پژوهش، با استفاده از روش دلفی فازی انتخاب شد. در پایان نیز پیشنهادها و راهکارهایی از جمله تدوین برنامه جامع توسعه میادین، استفاده از شرکت­های خارجی در قالب قراردادهای مشاوره و خدمات، همسویی هرچه بیشتر منافع کارفرما و پیمانکار در اجرای سریع­تر پروژه­ها، توجه جدی به توسعه فناوری در این صنعت، تقویت سازمان­ها و پیمان­های منطقه­ای به منظور تقویت دیپلماسی انرژی، تولید حداکثری در حداقل زمان از میادین مشترک و ... در جهت کاهش این چالش­ها ارائه گردیده است.

عنوان انگلیسی An Analysis of Challenges of Oil and Gas Upstream Contracts in the Islamic Republic of Iran
چکیده انگلیسی مقاله Oil and gas industry plays a key role in Iranian economy because of significant oil and gas resources in Iran. Despite over a century of experience of Petroleum contracts, our country has not yet been able to resolve its weaknesses, due to various issues such as political, economic, social, administrative, legal, historical, and cultural considerations. Iran, like other developing countries, suffering from lack of sufficient capital and technical knowledge as well as a desirable management capability for implementing upstream large oil projects such as exploration, drilling, development and production. So the presence of international experienced companies in this industry seem to be inevitable and it seems that this requires concluding cooperation agreements with these International Oil Companies (IOCs). Accordingly, after outlining the basic research concepts, the legal requirements and constraints governing upstream oil and gas contracts, in order to assess the challenges have been studied. Subsequently, 26 of the most important challenges out of the 40 identified challenges from the literature were selected using the Fuzzy Delphi method. Finally, there are suggestions and solutions to reduce these challenges including the developing a comprehensive plan for development of the oil and gas fields, using international companies in the form of consulting and services contracts, aligning the interests of the employer and the contractor in the implementation of projects, paying close attention to the development of technology in the industry, strengthening regional organizations and treaties to strengthen energy diplomacy, maximizing production from sharing fields in the least time to reduce these challenges etc.
