تأثیر متقابل فقه و اخلاق در راستای تأسیس دانش فقه اخلاق |

| چکیده فارسی مقاله |
در مورد رابطه دانش فقه و اخلاق، اختلاف بین دانشوران فقه اخلاق وجود دارد. بررسی رابطه فقه و اخلاق و امکان تاسیس دانش فقه اخلاق اهمیت به‌سزایی در رشد و تعالی این علم دارد. مقاله حاضر با روش تحلیلی-توصیفی در صدد بیان رابطه فقه و اخلاق و امکان تاسیس فقه اخلاق می‌باشد. برای دستیابی به این هدف نسبت‌سنجی و بررسی شباهتها و تفاوت‌های میان عناصر اصلی دو علم فقه و اخلاق صورت گرفته است. همچنین با رابطه‌سنجی فقه و اخلاق تعامل و تأثیرهای متقابل دو دانش بررسی شده است. یافتههای مقاله نشان میدهد در نسبت‌سنجی فقه و اخلاق، موضوع این دو باهم نسبت عام و خاص من وجه دارند و در محمول، هدف و روش نسبت آن دو تساوی است. در رابطه‌سنجی فقه و اخلاق تاثیر فقه بر اخلاق در مسائل، روش تحقیق، اهداف اخلاق بررسی میشود و در تاثیر اخلاق بر فقه ساختن مبادی حکم، تعدیل حکم فقهی، تحلیل اخلاقی از موضوعات و گسترش دامنه فقه بررسی می‌گردد. با توجه به آنچه که در نسبت‌سنجی و رابطه‌سنجی بیان شد امکان فقه اخلاق وجود دارد و برای آن دو تعریف عام و خاص لحاظ شده است که در تعریف مختار، اصطلاح خاص مدنظر است که در بردارنده احکام شرعی است به همان معنای فقهی که در فقه مصطلح وجود دارد. در نتیجه با توجه به این تعریف، در فقه اخلاق باید حوزه صفات و رفتارهای اخلاقی، با دقّت اجتهادی و روش استنباط فقهی مورد شناسایی تکالیف خمسه قرار گیرند. |

Regarding the relationship between knowledge of jurisprudence and ethics, there is a difference between scholars of jurisprudence and ethics. Examining the relationship between jurisprudence and ethics and the possibility of establishing the knowledge of jurisprudence and ethics is very important in the growth and excellence of this science. This article aims to express the relationship between jurisprudence and ethics and the possibility of establishing moral jurisprudence with descriptive-analytical method. In order to achieve this goal, the comparison and examination of the similarities and differences between the main elements of the two sciences of jurisprudence and ethics has been done. Also, the interaction and mutual effects of the two knowledges have been investigated by correlation analysis of jurisprudence and ethics. The findings of the article show that in jurisprudence and ethics, the subject of these two have a general and specific ratio, and in the predicate, goal and method, the ratio of the two is equal. In the relationship analysis of jurisprudence and ethics, the impact of jurisprudence on ethics is investigated in issues, research methods, and the goals of ethics, and in the impact of ethics on jurisprudence, making the bases of rulings, adjusting jurisprudence rulings, moral analysis of issues and expanding the scope of jurisprudence is investigated.
