عنوان فارسی حقوق شهروندی در چارچوب گفتمان انقلاب اسلامی
چکیده فارسی مقاله یکی از جلوه‌های جنگ نرم بر علیه انقلاب اسلامی ایران در دهه‌های اخیر آن است که این نظام سیاسی-اجتماعی حقوق شهروندی را زیر پا گذاشته و به آن بی توجه است. بر این اساس برای دفاع و معرفی اندیشه اصیل اسلامی در حوزه حقوق شهروندی، پژوهش حاضر می‌کوشد با بررسی مبانی و دیدگاه‌های مرتبط با حقوق شهروندی در مبانی انقلاب اسلامی، جایگاه این مفهوم و مولفه‌های برآمده آن را تشریح نماید. پژوهش حاضر از نوع کیفی با روش کتابخانه‌ای است که با تکیه بر آیات قرآنی و اسناد مهم حقوقی نظام جمهوری اسلامی ایران با روش توصیفی و تحلیل گفتمان لاکلا و موفه انجام گرفته است. در این پژوهش پس از کاوش در آیات قرآنی، دال‌های گفتمان اسلامی حقوق شهروندی استخراج گردید و سپس مصادیق عینی آن در اسناد حقوقی مهم نظام جمهوری مورد مطالعه قرار گرفت.حقوق شهروندی در گفتمان اسلامی بر مبنای نظام معنایی از دال مرکزی حیات طیبه و دال‌های اصل کرامت، امنیت و آزادی و ضمانت اجرایی حقوق شهروندی گرفته است. ارزیابی وضعیت حقوق شهروندی با توجه به بستر اجتماعی و سیاسی ایران پسا انقلابی نشان می‌دهد گفتمان انقلاب اسلامی پتانسیل قدرتمندی در تحقق حقوق شهروندی دارد. قانون اساسی به حقوق شهروندی در ابعاد مختلف شامل امنیت عمومی- خصوصی؛ حقوق قضایی؛ حق آزادی در ابعاد مختلف؛ حقوق مشارکت در اداره امور کشور؛ حقوق اقتصادی، اجتماعی و فرهنگی؛ و حقوق گروه‌های آسیب پذیر پرداخته است. همچنین اجرای حقوق شهروندی تصریح شده در این قانون، در بخشهایی از قانون مجازات اسلامی و آیین دادرسی کیفری تضمین شده است.

عنوان انگلیسی Citizenship Rights in the Context of the Islamic Revolution Discourse
چکیده انگلیسی مقاله Neglecting and ignorance of citizenship rights by the socio-political system is one of the soft war manifestations against the Islamic Revolution of Iran in recent decades. Accordingly, to defend and introduce the original Islamic thought in the field of citizenship rights, the present study aimed to explain the position of this concept and its derived components by examining the principles and perspectives related to citizenship rights in the Islamic Revolution foundations. To this aim, used library and descriptive method and discourse analysis of Laclau and Mouffe using Quranic verses and critical legal documents of the Islamic Republic of Iran. Then, the symbols of Islamic discourse on citizenship rights were extracted, and objective examples were studied in important legal documents of the republic. Citizenship rights in Islamic discourse are based on the semantic system from the central symbol of purified life and the signs of the principles of dignity, security, freedom and the executive guarantee of citizenship rights. Evaluating the status of citizenship rights in the social and political context of post-revolutionary Iran indicates that the Islamic Revolution discourse has a strong potential for fulfilling citizenship rights. The constitution addresses citizenship rights in various dimensions, including public-private security, judicial law, liberty rights in multiple sizes, participant rights in the administration of national affairs, economic, social and cultural rights, and the rights of vulnerable groups. The implementing citizenship rights specified in this law are guaranteed in parts of the Islamic Penal Code and the Criminal Procedure Code.
