چکیده فارسی مقاله اختلاف آرای فقها امری است که در فقه کاملا ملموس و مشهود است. این اختلاف نظرات می تواند معلول علل مختلی باشد. از جمله: اختلاف در تقسیم بندی اخبار که شامل اختلاف نظر اخباریون و اصولیون می شود. یا تعارض اخبار و راه های علاج آنها که تعارض خود می تواند دلایل و عوامل متعددی داشته باشد. عواملی مانند پیش فرض های فقیه در مراجعه به منابع فقه و یا دامنه اطلاع او از موضوعات احکام نیز می تواند از علل اختلاف آرای فقها باشد . همچنین سند یک روایت نیز از نظر فقیه می تواند مقبول یا مردود باشد که خود در تصمیم گیری فقیه نقش عمده دارد. دلایل دیگری نیز در اختلاف آرای فقها در رویکرد به اخبار نقش اساسی دارد که در این جستارمورد بررسی قرار می گیرد. کلید واژه ها: سنت، تعارض، سند روایت، جهت صدور روایت، دلالت روایت، مفهوم روایت.

چکیده انگلیسی مقاله Difference of opinions among the jurists is quite tangible and obvious in jurisprudence. This difference of opinions can have various reasons, including difference in categorizing traditions, which arises from difference of opinion between akhbāriyūn (traditionists) and uṣūliyūn (legal theorists), or the conflicts between traditions and the ways of their resolving. These conflicts may have numerous reasons and causes such as the jurist's preconceptions when referring to legal sources, or the scope of his knowledge about the subjects of the rulings, which can be among the reasons for the jurists' difference of opinions. Furthermore, the sanad (chain of transmission) of a tradition can be accepted or rejected from a jurist's point of view, which in itself has a major role in the jurist's decision making. There are also other reasons having a major role in the jurists' difference of opinions in their approach to traditions, which are dealt with in this research.
