عنوان فارسی بررسی و نقد نظریه های تعریف ملک در حقوق اسلامی
چکیده فارسی مقاله فقیهان، نظریه های گوناگونی را در تعریف مِلک ارایه داده اند. تعدد این نظریه ها، مفهوم فقهی ملک را با ابهام دچار ساخته است؛ زیرا که، همه‌ی این نظریه ها به علت تعارضشان با یکدیگر، نمی توانند با حقوق اسلامی انطباق داشته باشند و ترجیح یکی و کنار گذاشتن سایر نظریه ها، به دلیل نیاز دارد؛ در حالی که فقیهان، دلایل فقهی کافی را برای اثبات و انطباق نظریه‌ی خود با حقوق اسلامی، ارایه نداده اند. متأسفانه، تحقیق مستقلی که حاوی طرح، بررسی و ارزیابی همه‌ی این نظریه ها باشد، در این مسأله صورت نگرفته است و یک خلأ علمی در مسأله‌ی تحقیق مشاهده می شود؛ لذا ضرورت دارد محققان، این مسأله را بررسی و تبیین نمایند تا ابهام مذکور بر طرف و نظریه‌ی منطبق بر حقوق اسلامی در تعریف ملک، تحصیل گردد. ضرورت تحقیق در مسأله، آن‌گاه آشکار می شود که بدانیم تعریف ملک طبق هر نظریه ای آثار فقهی خاصی را به دنبال دارد. بنابراین، تحقیق فعلی، در صدد است تعریف فقهی ملک را بر اساس نظریه های موجود فقیهان طرح نماید و ضمن نقد و ارزیابی آن‌ها، نظریه‌ی تحقیق را بر اساس حقوق اسلامی در تعریف فقهی ملک تحصیل و تبیین کند و این مهم‌ترین یافته‌ی تحقیق، محسوب می شود. کلید واژه ها: حقوق اسلامی، تعریف ملک، سلطنت، حکم شرعی و عرفی.

چکیده انگلیسی مقاله Jurists have presented various theories on the definition of real estate. The numerousness of these theories has led to the ambiguity of the legal concept of real estate; for, all these theories cannot be conformed to the Islamic law due to their contradiction with one another and preferring one over the others requires proving; whereas, the jurists have not presented sufficient legal proofs to prove and conform their theory to the Islamic Law. Unfortunately, no independent investigation including the proposing, examining, and evaluating all these theories has been carried out on this issue, which has created a scholarly gap in research in this respect. Therefore, it is necessary for the researchers to study and elucidate this issue so as to remove the above-mentioned ambiguity and to achieve a theory consistent with Islamic law in definition of real estate. The necessity of doing research on this issue would become more evident when we know that the definition of real estate according to any theory would be followed by specific legal effects. Thus, the present research seeks to set forth the legal definition of real estate according to the existing theories of the jurists and, through critically reviewing them, to obtain and elucidate the research theory according to the Islamic law in legal definition of real estate. This is regarded as the most important finding of the research. Keywords: Islamic Law, definition of real estate, sovereignty, legal and conventional ruling.
