عنوان فارسی مطالعه انتقادی نظام دادرسی کار ایران؛ با نگاهی به نظام آلمانی
چکیده فارسی مقاله وجود نظام مطلوب دادرسی کار از مهم‌ترین معیار‌ها در تضمین حقوق کارگران است زیرا در صورت بروز اختلاف میان کارگر و کارفرما، حقوق طرفین به ویژه کارگر، به بهترین وجه تضمین می‌شود. متعاقبا، مطالعه نظام‌های دادرسی کشور‌های دیگر می‌تواند در کشف نقاط ضعف و قوت نظام داخلی مفید واقع شود. درهمین خصوص، یکی از مدرن‌ترین سیستم‌های دادرسی کار، متعلق به کشور آلمان است که ساختار قضایی مستقلی برای دادرسی کار پدید آورده است. لذا، پرسش اصلی نگارنده این است که با مطالعه نظام پیشرفته دادرسی کار آلمان چه انتقادهایی به نظام دادرسی کار ایران وارد می‌شود. این پژوهش که مبتنی بر روش تحلیلی-توصیفی است، با تکیه بر یک اصل روش‌شناسی در حقوق تطبیقی تحت عنوان «کارکردگرایی»، جایگاه، ساختار ، صلاحیت و شیوه رسیدگی در سیستم دادرسی کار دو کشور ایران و آلمان را تحلیل و بررسی نموده است. نتایج پژوهش در سه محور اصلیِ قضایی‌سازی و استقلال نظام دادرسی کار، تدوین ساز‌وکارهایی سودبخش جهت صلح و سازش و ایجاد رویه قضایی موثر خلاصه گشته که از ضروریات تحقق‌نیافته نظام دادرسی کار ایران است و قانونگذار باید تمهیداتی بیاندیشد.

عنوان انگلیسی The critical study of the Iranian labor adjudication system by the consideration to the German labor system
چکیده انگلیسی مقاله The existence of an effective labor adjudication system is one of the most important criteria in guaranteeing workers' rights, because in a dispute between a worker and the employer, the rights of the parties, especially workers, are guaranteed in the best way. Consequently, studying the other country’s adjudication systems can be useful in discovering the strengths and defaults of the domestic system. In this regard, one of the most modern labor adjudication systems belongs to Germany, which has created an independent judicial structure for labor proceedings. For the above reasons, the main question of this essay is that what achievements have the german system for the Iranian system. This research that is based on the analytical-descriptive method has investigated the position, structure, jurisdiction and, procedure of Iranian and German labor adjudication system by methodological principle in comparative law called "functionalism". The results of this study are to be outlined in three issues; the principle of judicialization and independence in labor adjudication, creating functional mechanisms for executing negotiation in pre-trial or in-trial and, making an efficient precedent that are needs of the Iranian system.
