عنوان فارسی بررسی ۴ ساله نظریات صادر شده در اداره کمیسیون های پزشکی تهران در پرونده های شکایت از خطای تشخیصی در موارد سقط درمانی
چکیده فارسی مقاله  سابقه و هدف: سالنامه آماری پزشکی قانونی نشاندهنده افزایش سالانه تعداد پرونده های ارجاعی به کمیسیون های پزشکی به دلیل شکایت از "خطای تشخیصی در موارد سقط درمانی" است. اگرچه شاید یکی از دلایل افزایش تعداد شکایات افزایش تعداد مراجعین باشد اما ارزیابی عملکرد متخصصان پزشکی قانونی در راستای یافتن علل روند صعودی شکایات ضروری به نظر می رسد.در مطالعه حاضر عملکرد پزشکان مذکور در رابطه با میزان رعایت آخرین قوانین مصوب در ایران در مورد سقط درمانی بررسی شد.   مواد و روش ها: در این مطالعه توصیفی گذشته نگر، تمامی نظریات صادره در پرونده های ارجاعی به اداره کمیسیون های پزشکی استان تهران به دلیل شکایت از "خطای تشخیصی در موارد سقط درمانی" از آغاز سال 1395 تا پایان سال 1398 بررسی شد. یافته ها : از مجموع 22 پرونده موجود، نظریات صادره درتمامی موارد مطابق با آخرین قوانین مصوب در ایران بود. بیشترین شکایات (9/40%) از متخصصان زنان و زایمان بود. در همه پرونده ها  سونوگرافی برای تعیین سن جنین (سن حاملگی) بین هفته 8 تا 10 بارداری انجام شده بود و سن حاملگی در زمان خطای تشخیصی کمتر از 19 هفته بود بنابراین می بایست کمیسیون پزشکی در مورد تمامی آنها تشکیل می شد که بدرستی انجام شده بود. بررسی نظریات صادره؛ نشاندهنده 6 مورد (3/27%) خطای انتظامی، 15 مورد (2/68%) برائت و 1 مورد (5/4%) عدم امکان صدور نظریه بدلیل نقص مدارک و مستندات موجود در پرونده بود. نتیجه‌گیری: اگرچه میزان تطابق نظریات صادره در اداره کمیسیون های پزشکی استان تهران با آخرین قوانین مصوب در پرونده های سقط درمانی 100 درصد بود اما به نظر می‌رسد آموزش مداوم آخرین قوانین مصوب در کشور در خصوص "سقط جنین درمانی" با توجه به تغییرات مکرر آنها برای پزشکان قانونی در راستای کاهش تعداد شکایات مرتبط ضروری باشد.

عنوان انگلیسی Examination of the opinions issued by the Tehran Medical Commissions Department in cases of complaints about misdiagnosis in medical abortion cases from March 2016 to March 2020
چکیده انگلیسی مقاله Background and Aim: The statistical yearbook of forensic medicine shows an annual increase in the number of cases referred to medical commissions due to complaints of "diagnostic error in abortion cases". Although perhaps one of the reasons for the increase in the number of complaints is the increase in the number of clients, it seems necessary to evaluate the performance of forensic experts in order to find the causes of the upward trend of complaints. In the present study, the performance of the aforementioned doctors was investigated in relation to the compliance with the latest laws approved in Iran regarding Medical abortion. Materials and Methods: In this retrospective descriptive study, all the opinions issued in the cases referred to the medical commissions department of Tehran province due to the complaint of "diagnostic error in abortion cases" from March 2016 to March 2020 were reviewed. Results: Out of a total of 22 existing cases, the opinions issued in all cases were in accordance with the latest laws approved in Iran. The most complaints (40.9%) were from gynecologists and obstetricians. In all cases, ultrasound was performed to determine the age of the fetus (gestational age) between 8 and 10 weeks of pregnancy, and the gestational age at the time of the diagnostic error was less than 19 weeks, so a medical commission had to be formed for all of them, which was done correctly. Review of opinions issued indicated 6 cases (27.3%) of disciplinary errors, 15 cases (68.2%) of acquittal, and 1 case (4.5%) of the impossibility of issuing a theory due to the lack of evidence and documentation in the file. Conclusion: Although compliance of conformity of the opinions issued in the medical commissions office of Tehran province with the latest laws approved in abortion cases was 100%, but it seems that the continuous training of the latest laws approved in the country regarding "medical abortion" due to their frequent changes for Forensic specialists is necessary to reduce the number of related complaints.
