عنوان فارسی تأملی بر آثار و پیامدهای دولت تنظیم‌گر بر حقوق بنیادین شهروندان
چکیده فارسی مقاله ظهور دولت­های تنظیم­گر یا مقررات­گذار از اوایل دهه­ی هشتاد میلادی یکی از گسترده­ترین و عمیق­ترین تحولات را در طیف وسیعی از دولت­ها به وجود آورده است. پرسش اصلی پژوهش حاضر آن است که ظهور و استقرار دولت­های تنظیم‌گر چه آثار یا پیامدهای مخربی در ارتباط با حقوق بنیادین شهروندان به همراه داشته است؟ در مقاله­ی حاضر ابتدا مفهوم، پیشینه­ی نظری، ویژگی­ها و سیاست­های برآمده از دولت­های تنظیم­گر را که گاه با عنوان مدیریت دولتی نوین نیز خوانده می­شود به اختصار مرور کرده­ایم، سپس ضمن بررسی پیامدهای استقرار چنین دولت­هایی در ارتباط با حقوق شهروندان چنین نتیجه گرفته­ایم که دولت­های تنظیم­گر تأثیر معکوسی بر تأمین نیازهای اساسی شهروندان، بهره­مندی آنها از عدالت و انصاف و مشارکت در امور سیاسی، همگانی بودن خدمات عمومی و بهره­مندی از یک محیط زیست سالم داشته­اند. در این بررسی­ها با استناد به پژوهش­ها و آمارهای منتشر شده­ی معتبر و بین‌المللی و با بهره‌گیری از روش توصیفی- تحلیلی نشان داده‌ایم که پیاده­سازی سیاست­های مربوط به دولت­های تنظیم­گر می­تواند چه نتایج وخیمی در ارتباط با حقوق بنیادین شهروندان به همراه داشته باشد. در نهایت، پیشنهادهایی نیز برای بهبود چنین آثار و پیامدهایی ارائه شده است.

عنوان انگلیسی A reflection on the effects and consequences of the regulatory government on the fundamental rights of citizens
چکیده انگلیسی مقاله The emergence of regulatory governments since the early 1980s has brought about one of the most extensive and profound changes in a wide range of governments. The main question of the current research is that the emergence and establishment of regulatory governments have brought about any destructive effects or consequences in relation to the fundamental rights of citizens. In this article, we have first briefly reviewed the concept, theoretical background, characteristics and policies emerging from regulatory governments, which are sometimes called new public management, and then while examining the consequences of the establishment of such governments in relation to the rights of citizens, we have concluded that regulatory governments have had an adverse effect on providing the basic needs of citizens, their enjoyment of justice and fairness and participation in political affairs, the publicness of public services and the benefit of a healthy environment. In these surveys, citing reliable and international published researches and statistics, and using the descriptive-analytical method, we have shown that the implementation of the policies related to regulatory governments may have dire results in relation to fundamental rights of the citizens. Finally, suggestions are also provided to improve such effects and consequences.
