عنوان فارسی تأثیر و تأثر مدیریت کارآمد و حقوق شهروندی؛ با تأملی بر قوانین اداری داخلی
چکیده فارسی مقاله فهم مدیریت کارآمد در معنای مدرن و تمایز آن از معنای کلاسیک از یک‌سو و تلاش در یافتن مؤلفه‌های مرتبط و هم‌سوی آن با حقوق شهروندی از سوی دیگر، شایسته تأمل نظری و تدقیق در مبانی و دلایل توجیهی آن است. بر این اساس، هدف اصلی این مقاله عبارت است از تبیین تأثیر و تأثر مدیریت کارآمد و حقوق شهروندی با تأملی بر قوانین اداری ایران. مقاله پیش‌رو، مبتنی بر رویکرد میان‌رشته‌ایِ حقوقی- مدیریتی، از شیوه کتابخانه‌ای و اَسنادی و تدقیق در قوانین و مقررات داخلی برای گردآوری داده‌ها و روش توصیفی- تحلیلی برای تجزیه و تحلیل داده‌های گردآوری‌شده بهره می‌جوید. یافته‌های پژوهش نشان می‌دهد مبتنی بر متغیرهای اعتماد عمومی و جهانی‌شدن، نظریه عدالت در سازمان و نیز رویکرد رفتاری و نظریه انسان دوساحتی از یک‌سو و تکلیف به راهنمایی ارباب رجوع توسط مقام اداری، ارائه اطلاعات و شفافیت در روابط اداری، کاربست صداقت و انصاف در مواجه کارمند با شهروندان و بالأخره ممنوعیت بی‌اعتنایی به مراجعین از سوی دیگر، مدیریت کارآمدِ مدرن و حقوق شهروندی دارای تأثیر و تأثر متقابل بر یکدیگر می‌باشند. همچنین، کاربست اصول مترقی حقوق شهروندی در اَسناد قانونی داخلی، به‌ویژه قانون مدیریت خدمات کشوری، علی‌رغم برخی کاستی‌ها زمینه مساعدی برای نزدیک‌سازیِ حدأقل تئوریک دو مفهوم مدیریت کارآمد و حقوق شهروندی ایجاد نموده که تفطن و فهم روشن از ارتباط و مآلاً کاربست آن‌ها در عمل لازم و ضروری است.

عنوان انگلیسی The Interaction of Efficient Management and Citizenship Rights Reflecting on domestic administrative laws
چکیده انگلیسی مقاله Understanding efficient management in the modern sense and distinguishing it from its classical meaning, on the one hand, and trying to find related components in line with citizenship rights, on the other hand, deserve theoretical reflection and elaboration on its justifications. Accordingly, the main purpose of this article is to explain the impact of efficient management and citizenship rights by reflecting on the administrative laws of Iran. The leading article, based on the legal-managerial interdisciplinary approach, uses the library and documentation method and the elaboration of internal laws and regulations for data collection and the descriptive-analytical method for the analysis of the collected data. Findings show that based on the variables of public trust and globalization, the theory of justice in the organization as well as behavioral approach and two-dimensional human theory on the one hand and the task of guiding the client by the administrative official, providing information and transparency in administrative relations, applying honesty and fairness. Employees with citizens and, finally, the prohibition of disregard for clients on the other hand, modern efficient management and citizenship rights have an interaction with each other. Also, the application of progressive principles of civil rights in domestic legal documents, despite some shortcomings, has provided a favorable ground for a theoretical approximation of the two concepts of efficient management and civil rights, which requires a clear understanding of the relationship and their practical application.
