بررسی امکان توافق راجع به نفقه همسر در حقوق ایران و انگلستان |

در قوانین موضوعه ایران، در نکاح موقت امکان توافق راجع به نفقه پیش بینی شده است، در خصوص نکاح دائم علیرغم اینکه ماده 1106 ق.م. نفقه زوجه را بر عهده شوهر قرار داده، ولی موضع قانونگذار در خصوص امکان توافق راجع به اسقاط یا تغییر الزام به انفاق در نکاح دائم روشن نیست و تصریح قانونی در این خصوص وجود ندارد. این در حالی است که قانونگذار انگلیس، سازوکار توافق را در الویت اول برای تنظیم روابط مالی زوجین قرار داده است. در مقاله حاضر، رویکرد دو سیستم حقوقی ایران و انگلستان در خصوص این موضوع مورد بررسی و ارزیابی قرار گرفته و این نتیجه حاصل شده است که تکلیف یکجانبه انفاق و رویکرد آمرانه قانونگذار ایران در عصر حاضر، منطبق با شرایط خاص همه خانواده های ایرانی نبوده و در وضعیت فعلی، به عنوان نقطه شروع در تغییر رویکرد قانونگذاری پیشنهاد شده است که همانند حقوق انگلیس، قانونگذار ایران در نکاح دائم نیز ضمن تصریح به امکان توافق راجع به نفقه، در جهت تعدیل تکلیف یکجانبه انفاق اقدام نماید. |

In the law of Iran, it is possible to agree on Maintenance in temporary marriage. On a permanent marriage, despite the fact that article 1106 of the civil code has entrusted the husband with the maintenance of a woman, but the legislator's position about an agreement on abandonment or change in the obligation to maintenance in permanent marriage is not clear and there is no legal provision in this case. On the contrary, English legislator has put the agreement mechanism at the top of the list to regulate couples' financial relationships. The present article explains the approach of the two legal systems regarding the issue. It is concluded that The Unilateral duty of maintenance and Compulsory approach of Iranian legislator, in the present era is not consistent with the specific circumstances of all Iranian families. In present situation, it has been suggested that, like the Law of England, the Iranian legislator expresses the possibility of an agreement on maintenance in the permanent marriage as a start in changing the legislative approach and modifying the unilateral duty of maintenance. |
