عنوان فارسی علل عدم شناسایی و مستندسازی اموال غیرمنقول دولتی در بستر حقوق اداری
چکیده فارسی مقاله شناسایی و مستندسازی اموال غیرمنقول علاوه بر حفظ و حراست در نگهداری، امکان نظارت­پذیری، توزیع عادلانه، استفاده مطلوب و مصونیت از تعدی و تعرض به آنها را در پی دارد. مسأله مورد مطالعه این است که دولت در شناسایی، تثبیت مالکیت و صدور اسناد مالکیت این اموال با وجود تکالیف قانونی، ناموفق بوده است. امروزه اثر ملموس عدم­شناسایی اموال دولتی، فراتر از بستر حقوق اداری، به حوزه­های اقتصادی، اجتماعی و فرهنگی نیز تسری یافته است و شاید بنای آن در همین بستر باشد. هدف مقاله، بررسی علل عدم­شناسایی و مستندسازی اموال غیرمنقول دولتی و ارائه راهکار سازنده و مؤثر برای ارتقای وضع موجود به شکل مطلوب است. مقاله با رویکرد توصیفی-تحلیلی، آثار قوانین و مقررات، نقش ساختارها و سایر عوامل دخیل در شناسایی و مستندسازی اموال غیرمنقول را تبیین می­کند. یافته­های پژوهش نشان می­دهد که دستگاه‌های بهره­بردار یا نمایندگان دولت (اشخاص عمومی) برای استیفای حقوق و اعمال مالکیت دولت بر اموال دولتی باید اقدام مجدانه نمایند و نسبت به اصلاح برخی قوانین و مقررات موضوعه و در مواردی، اصلاح ساختارها و فرآیندها، گام اساسی بردارند تا اموال دولت به طور کامل شناسایی، ثبت و مستندسازی گردد.

عنوان انگلیسی The Reasons of non Identification and Documentation of Governmental Immovable Properties in the Context of Administarative Law
چکیده انگلیسی مقاله Identification and documentation of immovable properties provide ability to monitor, distribution, appropriate use immunity in addition of maintaining. The case study is government unsuccessful in identifying and issued these properties' deed despite legal obligation. Today, the tangible effect of not identifying government property beyond the realm of administrative rights has spread to the economic, social, and cultural spheres, and perhaps its construction is in the context of administrative law. The purpose of this article is finding the reasons of non-recognition and non documentation of government properties assets and provide a constructive and effective solution for increase current situation to eligible situation. Article explain the influence of laws and regulation an role of structure and other factors involved in identification and documentation of immovable properties with descriptive and analytical tendency. Findings indicated that for adjudication and acts of ownership on asset properties, government should correct some rules, structures, and process to identify and operators or representatives of the government must take decisive action to enforce the rights and exercise of state ownership of state property and take a fundamental step towards proposing amendments to certain laws and regulations and, in some cases, reforming structures and processes be recorded and documented.
