از زمان تشکیل سازمان صداوسیما تاکنون، در هیچ‌یک از قوانین اختصاصی مربوط به این دستگاه، نسبت به تعیین ماهیت حقوقی آن مبادرت نشده است. برخی از قوانین موضوعه کشور به‌طور مبهم اشاره‌ای به ماهیت حقوقی این نهاد مهم و تأثیرگذار داشته‌اند که مقایسه آن‌ها با ساختار و عملکرد صداوسیما نشان می‌دهد ماهیت این نهاد در برهه‌ای از زمان با هر دو ماهیت شرکت و مؤسسه دولتی، در مواقعی با هیچ یک و در دوره‌ای به‌طور نسبی با مؤسسه دولتی قابل انطباق است. علیرغم وجود این ابهام، در طرح‌هایی که تاکنون در مجلس شورای اسلامی در خصوص اداره صداوسیما مورد بررسی قرار گرفته، به تعیین ماهیت حقوقی متناسب برای آن توجه کافی صورت نگرفته است. اگرچه ماهیت حقوقی این سازمان براساس قوانین موجود، در حکم مؤسسه دولتی می‌باشد؛ اما از آنجا که کلیه دستگاه‌های اجرایی و حاکمیتی باید ماهیت حقوقی معینی داشته باشند تا براساس آن اداره و نظارت شوند، ضروری است این مهم نسبت به سازمان صداوسیما نیز محقق شود. بنابراین لازم است ضمن اصلاح قوانین موجود، ماهیت حقوقی جدید و متناسبی برای این دستگاه تعریف شده و به کلیه ابهامات موجود پایان داده شود. |

Since the establishment of the Islamic republic of Iran Broadcasting organization (IRIB), no specific laws have been made regarding its legal nature under any of the applicable laws. Some of the laws of the country have vaguely referred to the legal nature of this important and influential entity which compares them with the structure and function of IRIB, The nature of this entity is compatible with both the nature of state-owned corporation and state institute at some time and in some cases with neither and in a period of time it is relatively compatible with the state institute. In spite of this ambiguity, the appropriate legal nature of the organization didn't attention to it sufficiently in the drafts of law that have so far been considered by the Islamic parliament of Iran. Although the legal nature of this organization is a state institute under existing law, But Since all executive and governing bodies must have a certain legal nature in order to be governed and supervised, it is essential that this is also the case with broadcasting organization. Therefore, it is necessary to amend the existing laws, define a new and appropriate legal nature for this system and be finished all existing ambiguities. |
