هر جنایتی که در جامعه رخ می‌دهد، هرچند کوچک، ابتدا جامعه را به خطر می‌اندازد و موجب بی‌نظمی و ایجاد ناهنجاری در جامعه شده و در وهله دوم در اذهان مردم برای مجنی علیه احساس ترحم می‌کند. اگر این جنایت را در کودکان تصویر کنیم، انتظار ما از جامعه این است که به سرعت آن را حل و فصل کند. تحقیق ما در مورد بزهکاری اطفال و مجرم نمودن صغار نیست، بلکه چگونگی وقوع جرایم علیه اطفال جامعه و به عبارتی عواملی است که موجب می‌شود اطفال قربانی جرم و بزه دیده شوند. انواع آزار و جرایم علیه آن‌ها؛ جایگاه کودک‌آزاری در قوانین جاری و راهکارهای مبارزه با این پدیده نیز مورد بحث و مطالعه قرار گرفته است. کودک‌آزاری امروز در غالب کشورهای جهان مورد بررسی قرار می‌گیرد، به نحوی که در کنار دادگاه‌های اطفال سازمان‌های مجهزی به منظور کمک و حمایت نسبت به کودکانی که مورد ... |

Crime of Child Abuse from the Viewpoint of the Islamic Penal Code and Twelver Shiite Jurisprudence |

When a crime occurs in society, albeit small, first it endangers the society and creates chaos in the society; in the second place, it make people feel pity for who was assaulted. If the victims are children of the community, we expect it to take action very quickly. This research is not about juvenile delinquency and not to criminalize children but to scrutinize how the crimes are performed against children. Also, social factors making children as victims of crime, all kinds of crimes and harms against children, the status of child abuse in current laws as well as several strategies to stop this phenomenon are discussed and studied. Today the issue of child abuse in most countries is examined in a way that all courts are equipped to be assisted by the professional children's organizations to support oppressed children under the oppression of their parents, guardians and trainers. Also in our country the Protection Law supporting parentless children in year 1974 was approved but was not effective for the children who are under the custody of their parents but practically are neglected by them and the society. |
