عنوان فارسی نگرشی نو بر مبانی فقهی حکم کالبد شکافی بر اساس آرای امام خمینی(س)
چکیده فارسی مقاله : از مسائل نوین علوم پزشکی، مسألۀ کالبد شکافی است که هر چند با اهداف اولیۀ متفاوتی مثل نجات جان فرزند زنده در شکم مادری که از دنیا رفته یا آموزش دانشجویان رشتۀ علوم پزشکی و... صورت می پذیرد، اما هدف نهایی تأمین سلامت بهتر و بیشتر انسان است. از آنجا که این مسئله سابقه طولانی ندارد، فقهای گذشته درباره حکم شرعی آن به‌طور خاص بحث نکرده‌اند. نوشتار حاضر در صدد بحث پیرامون حکم شرعی این موضوع و برخی مسائل مربوط به آن بر مبنای آرای امام خمینی است، که پس از توضیح مختصری پیرامون «اصل اباحه» به عنوان اصل اولی در مورد اشیاء و افعال، به بررسی ادله‌ای که ممکن است برای خروج از این اصل در مسئله تشریح جسد به آنها استناد گردد، پرداخته و به این نتیجه رسیده‌‌ایم که کالبد شکافی جسد مسلمان در شرایط عادی به دلیل روایات معتبر و متعددی که بر لزوم حفظ احترام بدن میت مسلمان دلالت دارند، جایز نیست، اما در شرایط اضطراری این حکم می‌تواند به صورت موقت تغییر کند. همچنین کالبدشکافی افراد غیرمسلمان و نیز اشخاص به ظاهر مسلمانی که به دلیل دشمنی با اهل بیت(ع)، احکام کفار برآنها جاری می‌گردد، بلا اشکال است. همچنین مسئله لزوم پرداخت دیه به سبب قطع اعضای بدن میت و نحوۀ عمل به روایات مربوط به آن در ارتباط با کالبد شکافی مطرح شده است ودر پایان به حکم اخلاقی کالبدشکافی پرداخته شده و به این نکته اشاره شده که حتی در مواردی که این عمل مشروعیت فقهی دارد، از جهت اخلاقی نامطلوب بوده و لذا جز در موارد ضروری نباید به انجام آن مبادرت ورزید.

چکیده انگلیسی مقاله Dissection is among new medical issues whose ultimate goal is safeguarding human health through education or even dissection of a pregnant dead mother to rescue her baby. Since it is not an old problem, jurisprudents in the past did not issue an fatwa on it. The present article is an attempt to discuss the canonical decree on the subject and its related issues on the basis of Imam Khomeini’s viewpoints. In the first place, therefore, the principle of permissibility regarding the things and acts is discussed to find an outlet to dissection. It is concluded that according to authentic traditions dissection of a Muslim dead body is not allowed under normal circumstances because preserving the dignity of a Muslim dead body is obligatory. But this decree can change at the time of necessity.
