عنوان فارسی بررسی ماهیت حکم شرعی با رویکردی به دیدگاه امام خمینی(س)
چکیده فارسی مقاله ماهیت شناسی حکم شرعی از دیرباز در مباحث علم اصول فقه مطرح بوده است. از نظر تاریخی، بحث از ماهیت شناسی حکم در دانش اصول فقه شیعه از ناحیه علامه حلی در کتاب تهذیب الوصول الی علم الاصول مطرح‌شده است. فقیهان شیعه در زمینه ماهیت‌شناسی حکم شرعی اتفاق‌نظر ندارند. برخی حکم را خطاب شرع دانسته‌اند که به اقتضاء یا تخییر یا وضع به افعال مکلفین تعلق می‌گیرد. بعضی دیگر حکم را اراده تشریعی دانسته‌اند که به وسیله خطاب، ابراز و آشکار می‌گردد. برخی دیگر حکم شرعی را نظیر محمولات کلی مجعول برای موضوعات خود دانسته‌اند که وجود آن به‌صورت قضایای حقیقی مفروض گرفته می‌شود. امام خمینی ضمن نقد مبانی نظریات مذکور، حکم شرعی را امری اعتباری تلقی می‌کند که جایگاه آن، عالم اعتبارات است؛ بنابراین نظریات فقیهان درزمینه ماهیت شناسی حکم شرعی را می‌توان چهار نظریه خطاب، اراده تشریعی، جعل و اعتبار ارائه نمود.

عنوان انگلیسی A Study of the Nature of Canonical Decree with Emphasis on Imam Khomeini’s Viewpoint
چکیده انگلیسی مقاله Studying the nature of canonical decrees has been a subject of the Principles of Jurisprudence for a long time. Historically, the study of the nature of a decree in Shia Principles of Jurisprudence was discussed by Allameh Helli in his book, Tazhib al-Wusul Ila Ilam al-Usul. There is no unanimity among the Shia jurisprudents about the study of the nature of canonical decrees. Some of them consider a decree the address of Sharia which belongs to the deeds of the faithful based on requirement, situation or will. Some others consider decree a legislative determination which is revealed through addressing. Some others consider canonical decree like a general proposition coined for subjects whose existence is supposedly accepted as true theorems. While criticizing the principles of the said theories, Imam Khomeini considers canonical decree conventional ideas  whose place are in the conventional world; therefore, the viewpoints of the jurisprudents in the field of studying the nature of canonical decree include address, legislative will,  coining and conventional ideas.
